  2. Go to the exchange website and enter the same salary as last year and see how much they have to pay and see how much they actually paid. You are right, maybe the website was too generous last year.

  4. About 5 years ago, MD was giving state refunds to people with W-2 regardless of the SS# number on the return. A lot of regular people using a fake social security number would file with that social security number and the tax preparer would add three dependents to the return and get whatever they withheld and EIC from MD. One day I got a call from someone who wanted me to prepare ONLY the MD returns. I said, I will have to charge you for the whole federal and state return and he said no problem. I always ask for new people to bring a copy of the return previously filed. When I said, where are these three children, he said, I don't know. The preparer gave me that information and I want to file like last year. I told him that what he did was illegal and the we didn't do that. That if he wanted, I could apply for an ITIN and that I normally filed electronically. I gave him his papers back. About 4 years ago, I posted something here stating that MD was going to go bankrupt if they continue to issue those refunds. I am glad they stopped doing it. On January 28th, I prepared a return for one of my clients who needed his refund badly, but he didn't give me his 1095-A. I told him their refund (MFJ) was going to change but that I was going to file MD so they could get that money. I tried to efile and I got a rejection because the Federal Return was not filed. This will hurt me because when people request their ITINs, I used to file MD electronically when the ITIN was issued.
  5. Asking very softly is a good start. I guess you don't want the IRS to hear you asking that question. No, there should not be any penalty.
  6. Assuming you are talking about an IRA, yes, you don't pay the penalty up to 10K on money used on the acquisition or building of a house. If you didn't own a house for the last 3 years, you are considered a new buyer. Now that you mention 2 years, I am confused, so it could be 2 years or 3 years.
  7. Put the number for each of the three columns, filing status, and MAGI (ss income, etc) and we will tell you if you are correct. Remember to place a 0 on dependents, ss income and the other box if appropriated.

  9. In a situation like this, I tell the child to go to the same place where the mom did her taxes and I offer them my services to the mother and the child for next year. I normally don't get involved in a sticky situation if I didn't prepare both returns. I guess my approach creates a conflict of interest but at least I apply the rules correctly and if they don't like my approach I ask them to go to H and R block and I suggest to take both cases to the same place.
  10. I think so. I always reboot my computer after I do two updates and for sure when I update ATX. I know it is a pain to waste those 10 minutes, but then I organize my desk, talk to my clients, call my clients, check my mail, have a tea (margarita or wine), go for a quick walk, file my paper on my cabinet, vacuum my office, etc.
  11. When you amend returns for previous years, chances are that the IRS has changed addresses or locations. Just saying.

    I just tell them. Do you play the lotto? if you don't have insurance and if you hit the lotto for 500m, you will have to pay $4,896 in penalty. So, I entered $500,000,000 on W-2g and $30K on W-2. If you don't hit the lotto, you will pay $398 in penalty
  14. As long as the child didn't provide more than 50%, the mother can claim the child even if he made a million dollars. For HOH, the mother must provide more than 50% of support and maintain a house which was the main house for one of her children (not necessarily the student).

    I tell people: Did you have insurance last year? they say no. I say... You will have to pay a penalty this year. and they answer no problem. I say... for next year, you should have health insurance or the penalty will be double or more. They say, no problem. I go and prepare this year's taxes because that's what they hire me for. I don't sell insurance and I am not in a position to force them to buy health insurance.
  17. That means that my guy had almost 100% gain. I was wondering how he could have such a big gain within one day.
  18. When you said that this amount is reported on the W2, are you talking on box 1 or on box 12 with a W code? I have the same situation and what I have a is document that reads that he bought and sold on the same and his basis was 12K and he sold it for 20K. So in this case, the guy had a gain but there also something on his W-2. Based on what you are saying, these transactions never result on a gain, correct?
  19. I have cancelled the update by removing the LAN cable from my computer or by pressing cancel on the update. I will update when I am force to do by efile.
  20. Today is the perfect day to update because IRS cut date was yesterday. We have 5 more days to fix it without delaying IRS refunds. Did someone installed the Patch without any issues?
  21. How many have you rolled after you discovered the issue? Have you opened the offending return in 2013, change something save it and then roll it over?

  23. In any event, the buildings will be gone to the person who sues me whether they are under my name or the LLC's, correct?

    That's correct. The calculation is 95/12*9 or 5600*.01, whichever is higher. As we said on another post, unless you are a heavy smoker, health insurance will always be affordable. If you make too little, the government will pay a lot and that will make it affordable. If you make a lot, you will be able to afford it. The affordability is like your medical bills that you paid are deductible. Have you had any one that qualifies to deduct his medical expenses now that it is raised to 10%?
