  1. sorry, wrong wording. I'm not sure how to treat the withdraw from the IRA. As a normal early withdraw? All taxable? He has no "non-deductible contributions" also, correct? It's strange that I had three clients all today with the same situation.
  2. Well, the child is not a qualifying child of mother because child didn't live with mother for more than half of the year. The child wouldn't be a qualifying child of the friend because it is not the friends son, daughter, stepchild, foster child, brother, sister, etc. The child wouldn't be a qualifying relative of the friend either because the child did not live with the friend as a member of the household all year. Hmmm..good question. Anyone?
  3. How long has child been living with the friend?
  4. That sounds nice! I'm hoping to get a few of these returns off my desk today just to go out to dinner tonight. My hubby is getting a little irritated with me. What can you do? Happy Valentine's Day!
  5. I have SO many clients this year that have lost their jobs, homes, retirements, etc. It's crazy. And I keep reading about 3 situations I just received this morning and am getting myself confused so I'm asking if someone can clear my head. Client works, has a 401k. Company closes. Part of loan on 401k that is not repaid back is show on 1099, code 1. Another 1099 show client rolled over remaining 20,225.00 into an IRA. Then client has a 1099 for early withdraw from IRA for 18888.88 with code 1. So he rolled over 401k into an IRA, then withdrew IRA, all within 2 months. (left a little bit in the IRA) I get the loan, I get the rollover, it's the contribution to the IRA, then the withdraw 2 months later that is getting me for some reason. I'm losing it I guess. Can someone help me out here? It would be much appreciated.
  6. Ok, thanks! I am able to get the EIN from last years w-2.
  7. Can we do this? I tried to create the e-file just for the fun of it to see what would happen. No errors..hmm. I guess I always thought we couldn't e-file with form 4852. Can we? Or will it get rejected? (I just figured that it wouldn't let me create the e-file in the first place but it will let me)

    efile form 4852

It looks as if I can create the efile with no problem, although the return has a substitute form w-2 with it. Can we actually e-file with form 4852? I guess I never thought we could. (maybe we can't and the return would get rejected...I don't know) But it seems like it wouldn't even let me "create" the efile with it.
  9. Couple want to file injured spouse because of back child support the dad owes. It looks as if you can e-file the Federal thru including the injured spouse form. They do NOT want to file this way for Michigan. (They swear that Michigan will not take the refund for back child support and I am not up on that sort of stuff so I am taking their word) Anyway....If I efile the Federal thru with the injured spouse form, will Michigan think that they are wanting to file as injured spouse with them also?
  10. So far...no problems. I know it doesn't sound fun...but I would call support if I were you. The one time I did have to call, it was a long wait, but they were able to resolve my problem pretty quickly.
  11. If someone supplies you with an incorrect SS number...say....it shows YOUR SS number on their W-2, what do you do?
  12. After trying a few other programs, I have decided to stick with ATX. But the CODES, PASSWORDS, NUMBERS, etc are really trying my nerves. You have your ATX client ID, Username, Password, Approval code, Reference Number, savings code, renewal code, installation code....etc. I had to change my password, which I'm seeing that others had the same problem as I. I almost gave up then but finally got that to work. Now, I never received an installation code for my program. According to the correspondence I received, I should have it, or could just renew online and get it then. Couldn't do that either. Can't get ahold of customer support, of course. I have paid for the program and can not install it without the code. Did anyone else wait until the last minute as I and have any problems. Or am I just missing where this "installation code" is located?
  13. The sole proprietor now formed a single member LLC and is treated as a "disregarded entity". He will continue to file a Schedule C. I'm not clear on how to deal with the depreciation that has already been taken when filing as a sole proprietor. Any help?
  14. Sole proprietor now formed an LLC. How do you deal with depreciation that has already been taken?
  15. JB - I love your picture! It makes me smile. I have 5 1040's that I transmitted on 4/15 that are still "validated by EFC" as well. I've synched with ATX, but still "validated".
  16. No extensions for me! 645 returns later and I'm done today. Matter of fact, I'm just waiting for people to pick up now. If someone comes in with something simple, I'll do it. Otherwise, I tell them they'll have to go somewhere else. They know I don't do extensions. It's been a crazy tax season, but it's over for me today! (now I have my Township meetings tonight......)
  17. I got a phone call from them the other day. I asked them a million questions and (initially) it sounds like something I would check out. I asked them to send me a demo disk, which I received a few days later. I haven't checked it out yet, but will when everything dies down here.
  18. Must be Murphy's Law - my Laser just quit on me the other day. Then it finally spit out a page that said I needed to replace something. (I can't remember the wierd name) I called Dell to order this wierd thing and the guy said it sounded like my drum was going out. I told him I just replaced my drum two weeks ago. He said, ok, we need to reset the drum counter. After turning off the printer, opening the front cover, pushing the continue buttom five times in a row, watch the flasing led lights do a correct light show, turn on the printer, push continue, push cancel, push continue two more times, ......and on and on and on...... if finally reset and all is good in the world. And to think I almost threw the darn thing out the window.
  19. I agree with ya there. I can't charge those prices. Well, I probably could but I probably wouldn't get paid for it.
  20. I sure do! I have a farmer that brings in his receipts all stuffed in a bag, crumpled up and he raises pigs to boot. So the stuff stinks. I get the rubber gloves out and sit a night or two and take all the receipts out, unfold them, sort them, etc. (and of course mumble to myself how I hate going thru his receipts) He is an older man, very nice. The kicker is - he can't read. I found that out a few years ago when I had to call him in to tell me what some receipts were. He couldn't tell me because he can't read them. The local businesses know him well and knows he can't read so I can call them anytime about certain receipts and they are more than willing to help me (him) out. When it's time to pay me, I tell him what he owes, and he hands me a blank check for me to fill it out and he just signs it. I would love to get rid of him, but I know that nobody is going to put up with going through his mess of receipts. And if they do, they will charge him pretty well. I've been doing his return for many years so I only charge him $10.00 an hour to go thru all his receipts. Call me a sucker, but again, he's a really nice guy.
  21. Extensions? Don't do 'em. Won't do 'em. Everyone knows when their taxes are due. Clients come into my office on April 14th, laughing, telling me they know they waited but can I get them done for them anyway. If I have the time, I will. I WILL NOT file an extension for them and do it later. My tax season ends on April 15th. If I don't have the time, I tell them they will have to go somewhere else. End of story. I have another job that takes up a lot of my time. I don't have time for procrastinators. Matter of fact, on April 15th, I have election training that I HAVE to go to (changes for the upcoming August Primary and November General Elections) from 9-12. I am skipping the afternoon session. Then I have a Zoning Board of Appeals meeting at 6:00, then our regular Township Board meeting at 7:30 and I'm preparing for a School election that is this May 6th also. I get 20-30 AV applications for ballots in every day that I have to process. Am I cranky right now? YES. Will I do extensions? NO. Now do I have to get back to work? Unfortunately YES.

    Form 5329

I guess I was looking for more and working too much. But thanks for your reply. Much appreciated!

    Form 5329

Client is 60 yrs. old. Factory he worked at shut down and he took a total distribution of his 401K. Under the "exceptions" on form 5329, Code 01 states: "Qualified retirement plan distributions (does not apply to IRAs) if you separated from service in or after the year you reach age 55 (age 50 for qualified public safety employees)" Would this qualify in this situation?
  24. It works to say "I won't have any appointments available for a few weeks, but it you drop yours off, I work on drop-offs after 6:00 and it will be done in a couple of days." Has worked every time. Nobody wants to wait. Of course, when you call them to let them know the return is ready, it takes them a week or two to get in to sign. Can't figure that one out.......
  25. Client received a redemption (settlement) from a work related injury from her employers workers' comp carrier. Total settlement was $206,000.00. The breakdown of the settlement is as follows: Redemption Settlement Amount: 206,000.00 Attorney Expenses: 1947.24 Attorney Fees: 21,655.28 Redemption Fee: 100.00 Net to Plaintiff: 182,297.48 Of the original $206,000 settlement amount, $21,000 is allocated to a Medicare Set-Aside Allocation. Also, it states that the amount of $14,000.00 is factored into the allocation amount above for future prescription drug treatment. I'm thinking not, but is any of the amount allocated above (of the $21,000) taxable? (editing) She also received $30,000 for wrongful termination. Of that amount, $13,398.43 went for Attorney fees.
