Client was 59 years old on March 17, 2014 and he took out 401k moneys on Sept 4 and Sept 14, 2014. I just want to double check. He has to pay penalty, correct?

When the process makes sense, I bet you they will do it. In this case, it makes sense that if the refunds will be delayed or clients might get a letter about a check mark, you get an error message. When you forget to check the box that reads "did you complete this form from the information provided by the client" when filling out the EIC checklist, you are not able to efile.

Thank you. DC also has a renter/real estate tax credit but only for household that make less than 20K AND they live the whole tax year in DC. I think all the states allow moving in expenses and they don't honor moving out expenses.

The gap exceptions is only 2 months (not 3).

Welcome to the board. You got the answer and I just want to add: 1.- Fill out the form anyways because they computer might generate a letter to your client if you don't mention ACA for 2014 and later years. 3.- Even if they register before Feb 15, client will be penalized if they didn't have insurance in 2014 AND they will be penalized for not have 2 months of insurance when they file their 2015 taxes in 2016. There a good course at www.apluscpe.com that is called ACA in the real world, you should take that video course since it only costs $5.95. I took it and it is worth it. If you have more questions, please feel free to post them and a lot of people will help you.

It only happens to me when my computer is busy booting up. So I just wait a couple of minutes while my computer gets less busy and it works like a champ.

What do you mean by substantial? If 5K is substantial, I guess he reported less than 5K. Yes, you can amend them and pay if clients owes but client cannot get a refund, as you correctly stated.

My clients moved to Milwaukee in August 2014 and wants me to do their taxes. In Milwaukee, they are employees but they bought a house. They moved because of a job offer so they will have moving expenses but that's it. In MD, wife closed an LLC and husband worked as self employed and were renting a room from a house and after august they fully rented the house. In reality, a Wisconsin preparer might difficulties doing the MD return AND I will have difficulties doing their Wisconsin return. I didn't want to their taxes but I believe this year I will be the best equipped for their situation so I am going to accept their request. Any advice about part year residents in Wisconsin and/or Milwaukee?

I went on line and I saw that the IRS has form 1040NR available to the public. My ATX states that form 1040NR has not been approved and when I print it I get the "draft" message printed. I looked on line and I didn't find anything stating that 1040NR is delayed by the IRS. If someone is using other software package, can you check to see if form 1040NR is available and ready to be shipped? Is the delay on the IRS part or is it ATX's? Thanks.

I think for 2014, clients should be prepared to answer ACA questions if they are audited. So, it is a good practice to ask and document ACA compliance so when they get audited they say "My tax preparer did NOT ask me anything about it". OR "My tax didn't ask me nothing about it".

Maybe we should get a certificate on this forum after answering some questions and posting important information about tax matters. KC and Judy should decide who gets the certificates and they should be huge posters because you learn more here than anywhere else.
