    Jainen, This is the first I've heard of this. Checked the FTB website instructions and sure enough, there it is. However, have you noticed that ProSeries still shows all 4 quarters equally divided? This could get nasty.
  3. I just returned from the IRS Vegas forum (took a few extra days). At the CTEC presentation, they said that "typists" (read data entry clerks) do not have to be registered. When I questioned them because of the August newsletter, they said the newsletter was in error. They did not bring up the error on their own, and when I commented that I apparently paid for a qualifying course for my "typist", the only response was "Sorry." Fat lot of good that does since I am now out the money and the clerk out his time. I just wanted to bring this to your attention. Sandy

Pub 15 says: "Payments for the services of a child under age 18 who works for his or her parent in a trade or business are not subject to social security and Medicare taxes if the trade or business is a sole proprietor or partnership in which each partner is a parent of the child." The older child is subject to both. I don't see how this child would not be an employee vs. IC.
  5. It's the last day to file a 2004 return. I would suggest that the client send it certified, with return receipt requested so that they have proof of timely mailing.
  6. Think of it this way - how would you feel if it was your personal return? Wouldn't you want your preparer to be up-front with you? Wouldn't you want the extra $1000? Your client will be impressed that you did an extra review and admitted to being human.

    Form 1040X

    I was taught to keep it short and sweet. I would simply say, "Corrected W-2 received after original filing." Then I would attach all forms that were changed because of the new W-2. I've never been challenged.
  8. I have a little different perspective on this. I am a ProSeries user who was originally granted access to the ATX forum when I demo'd ATX several years ago. Although I decided ATX was not for me, I have valued reading the posts and replies that both forums have generated. I appreciated the breadth of knowledge and have learned many things just from reading and lurking. Thank you for allowing me to continue to be part of this forum.

  11. But Pub 524 address the issue of the "mom" being able to take a credit. That's not the question, the daughter is. So I still go back to the original question. For qualifying child, she meets all the rules. Rule 2 states, "The child must be (a) under age 19 at the end of the year, ( under age 24 at the end of the year and a full-time student, or © any age if permanently and totally disabled." © would indicate that to be the case based on the doctor's letter. Even though she made $5000 that still only works out to 13 hours a week - certainly not enough to provide her own support. I don't see anything that says that she must have a letter from Social Security. I agree that the mom should look into SSI, however.
  12. FWIW, I use ProSeries and a couple of years ago it had horrible support. I fussed my way up the corporate ladder and finally had my entire program fee refunded and received a large discount on the next year. You have to decide how much time and effort you want to put into this. For me, it was well worth the hassle.
  13. Thank you jainen and Alpha. I guess the mom has to apply for SSI. So if I'm understanding you correctly, until that time, the daughter is neither a dependent nor qualifies mom for HOH. Gotta love this board.

But Pub 501 says, "For purposes of this test (the gross income test), the gross income of an individual who is permanently and totally disabled at any time during the year does not include income for services the individual performs at a sheltered workshop. The availability of medical care must be the main reason for the individual's presence there." She did not work at a sheltered workshop. Would that change your answer?
  16. Client (single mom) has a 21 year old daughter and a doctor's letter stating that she is permanently and totally disabled. Daughter worked for part of the year and earned about $5000. Please correct me if I'm wrong. From what I'm reading in the general instructions and Pub. 501 - unless the daughter worked at a "sheltered workshop" (which she didn't) the mom cannot claim her as a dependent (because of income), but she still qualifies the mom for HOH. Is this correct? Thank you.

  21. First off, KC, I have the greatest respect for all the advice you give, not only on this forum, but many others. I did file 1 return with a 5695 and 1 with an 8863 on 2/1. As soon as I hit the send button, I thought, Oh crap! They were both accepted and the acceptance date shows on the 9325. Was this a fluke? I don't know as I am holding the other returns with the affected forms until next week. I certainly did not mean to stir up trouble. I am not "trolling" as someone else suggested. Sandy
  22. ProSeries is able to file 5695 and 8863. I've already submitted both and had them accepted by the IRS
  23. If you have a George Forman grill, that is ideal for cooking bacon. All the grease drips off and is caught and the bacon stays nice and flat.
  24. I'm a part of this forum because I demo'd ATX. I have, and currently, use ProSeries but am thankful for all the things I learn here. I've stayed with PS for a number of reasons. Familiarity, and I like the way it functions being the most prevalent reasons. I have found that when I do have a major problem (and there have certainly been support issues), the louder I yell, the better deal I get the next year. Two years ago I hollered so loud that I not only got the entire program amount refunded, but they also refunded the PPR amounts and an additional amount. When they made they offer to ATX last year when CCH acquired then, I was very, VERY, vocal about having a better deal for new customers as opposed to retaining long-time loyal clients. As a result, I was offered the same deal for 3 years. I've found that you have to be a squeaky wheel with whomever you want your relationship. I am happy with PS and have already renewed. Thank you for all of the advice and wisdom that I've gleamed from this forum. That is certainly one area where PS is sorely lacking.

    Most of the ProSeries feedback that I heard about was not very positive.
