That is the problem, if you don't 'create' the efile, it does not have a DCN assigned. And so I have to create it, first. Especially if the client is in another state, and we are doing it all electronically. I have to print the pdf and send it to him to sign. Then I have to go and make sure that the efile is 'held'. I've been relying on the printing to cause a 'reject', but that makes me uncomfortable. I'd rather get it all set right, but 'held', until I get the signed form back. Then I can change the date signed to the actual date on the form, and create again, then transmit. -
Haven't researched it, but I'd go ahead and file an extension for him, since he's the one with the income that should be all the protection he needs.

I'm going to be posting a suggestion that they add a Preference option on efile to Hold the entire efile both Fed and State. Right now you have an option to 'hold' the STATE efile, but not to hold both. I often finish a dropped off return and then have to wait for them to come in and sign. And each time I have to remember to change them from 'created' to 'held'. I'd really like the option to have them 'held' as the default, so no one gets 'accidentally' transmitted before it is signed. If you think that would be a good option to have, please send your own 'suggestion', as I am sure that the more people ask for it, the more likely they are to add it.

I think it might depend on the info you get from the school where he took the training. They should be able to answer that question.

And remember that newpaper delivery is one of the oddball ocupations that are statutory nonemployees, so their income should be in the 'direct seller' box, rather than in box 7. And if they are under 18 they are exempt from all SE and payroll taxes.

Yes, you can do bulk extensions very simply. ATX calls them 'batch extensions'. You need to mark the returns you want to extend, then on the first drop down menu, select 'create/print extensions. It will then give you the option of 'for marked returns with zero' which will do all of them, or 'for marked returns with custom amounts' which will add the form but wait for you to input amounts.

The Internal Revenue Service has made slow progress in implementing federally required security settings on nearly 100,000 desktop and laptop computers, said a newly released report. The report by the Treasury Department’s Inspector General for Tax Administration found that the IRS has implemented about half of the 254 required security settings on its computers in October 2008, nine months after the deadline set by the Office of Management and Budget. As of December, the IRS had implemented 81 percent of the settings. According to the report, the delays in implementing the settings were due to the untimely creation of a project team in January of 2008 to implement the settings, a week before the deadline for completing the installation. Once created, the team did not follow basic project management practices. The report also found that the IRS has not implemented an automated monitoring tool to detect and monitor changes to the settings after installation. In addition, the IRS has not modified its software contracts to ensure that new software operates properly with the settings. “This report reveals a troubling situation,” said Treasury Inspector General for Tax Administration J. Russell George in a statement. “The security of IRS computers is critical. Taxpayers have every right to expect that the IRS protect their privacy and personal information to the highest possible degree. Without a complete set of security settings on employees’ computers, the IRS is at risk of business disruption and unauthorized access to taxpayer data.” TIGTA recommended that the IRS improve its technology project management practices, consider acquiring an automated monitoring tool and prioritize the updating of software contracts. The IRS agreed with TIGTA’s recommendations.

Catherine is right, it's not worth the extra hassle. Just go ahead and paper file it, and it's done. If you want, you might adjust how much you charge for that form to reflect the extra time it will cost you because it's not efileable. Just a thought.

Now Rita, you know it's not allowed to strangle them. Even when they deserve it! Find some gentler way to kill them, please. BTW, I don't waste much time 'explaining' for the first type question, I just add a W-4 to their return, fill it out as I think best, and print it and hand it to them saying "If you want to, give this to your employer, and that will fix it." That puts it on them, and does not waste a bunch of my time explaining things. It's then totally their call whether they use it or not.

It is, at least in theory, a tax rebate, not welfare and not releated to SE tax. I'd urge him to keep it, or at worst, to donate it to his church, rather than return it to the dunces in DC. Just my 2¢

CITY INCOME TAX ACT (EXCERPT) Act 284 of 1964 141.688 Statute of limitations; waiver; payment of tax. Sec. 88. (1) Except in case of fraud, failure to file a return, failure to comply with the withholding provisions of this ordinance, or omission of substantial portions of income subject to the tax, an additional assessment shall not be made after 4 years from the date the return was due, including extensions, or from the date the return was filed, or the tax was paid, whichever is later. An omission of more than 25% of gross income is considered a substantial omission of income. Under this section a declaration of estimated tax is not considered a return. (2) If the federal internal revenue service and a taxpayer execute a waiver of the federal statute of limitations, as to a taxable year, the expiration of the period within which an additional assessment may be made by the administrator or the department or a claim for refund filed by the taxpayer for such taxable year for city income tax purposes shall be 6 months from the date of expiration of the waiver. History: 1964, Act 284, Imd. Eff. June 12, 1964 ;-- Am. 1996, Act 478, Eff. Jan. 1, 1997 So the real question is, did she ever file that year's tax return? Filing is what starts the clock ticking, so if she sends them a copy of her return she filed, that should settle it. Of course, it is likely she no longer has copies of anything she did that long ago. But I'd suggest that you write a letter stating that she filed, [assuming she says she always filed her returns] and that the SOL has long run on that year. By the way, it took me about 30 seconds to find this info using google.

You may depreciate property that meets all five of the following tests. It must be property you own. It must be used in a business or other income–producing activity. It must have a determinable useful life. It must be expected to last more than one year. It must not be excepted property. Excepted property (as described in Publication 946, How to Depreciate Property) includes certain intangible property, certain term interests, and property placed in service and disposed of in the same year. Now, if this is a 225 year old instrument, I'd have a real problem with the third test. To be depreciable, your property must have a determinable useful life. This means that it must be something that wears out, decays, gets used up, becomes obsolete, or loses its value from natural causes. On it's face, this instrument just becomes more valuable over time, not less. By the way, if you did do this, you would use Form 3115 to make the catch-up depreciation deduction.

To have your settings stay as you left them, you want the 'Return to default' to be UNCHECKED. Also, on the Preferences, the first tab, you can set it to show only the 'Incomplete' returns as your default, although you can at any time change that with one click, but when you open up, it stays checked until you uncheck it. Just check the third box. I like this one because it shows me the ones I'm working on.

I'd say two things. One, it's good for your spirits to fire at least three PITA clients each year. That said, it's not bad to have some of those procrastinations as clients, as long as you handle them right. One, you file extensions, absolutely. Two, you charge extra to anyone who does not have their data to you by the end of March, at the very latest, middle of March is my cutoff for normal fee. Third, you do not give them ANYTHING except the extension until you are PAID IN FULL, unless they have a refund and you are using Fee-Collect. There is no excuse for someone making you wait for your fee any longer than that. And those who owe, who can not pay out of their refund, are the ones you should collect in advance of giving them anything. And don't feel bad that you are giving them a higher fee, part of that is for having to wait to get paid, after all.

Maybe you do not have it installed on this computer? If it is a new one in the last year or two, you might not have installed that printer option. It's on the CDs from older programs, but since they came up with their own pdf program, they don't give it to you anymore. But you could dig out an older version cd, look at the directory, and find the icon to install it.

I'm frankly too scared to count how many I have left, because I am afraid I might just break down and cry, But I don't 'ask' them about extensions, at this point I just TELL them they are going to be extended. If I get all the ones out that came in an a timely fashion, I will be happy. Those that waited are not going to make their procrastination become my problem.

I believe you would be smart to leave it alone, and call tech support in the morning. It clearly has some problem, and you might make it worse if you keep trying things. Rather than lose all the work already done, [i am assuming this is one you have already worked on] I'd wait for tech help with it. Of course, if I am wrong, and you just rolled it over, then I would delete it, open up last years program, open it up there, save it, and duplicate it, and then try rolling over the duplicated version. If the problem is with something in last year's copy, that might give you a clean copy that will rollover without the problem, and open OK.

If you get many of these, you might want to acquaint yourself with another tab on the 1040 form that I just noticed for the first time. Click on the "Pages & Worksheets " tab, and look down it right after the Line 63 Est Tax tab, for a tab called "Divorced in 2008". It's all set up to deal with people who divorced this year, but made joint estimated tax payments, or made estimated payments under the married name, and have now changed that name.
