    Taxbilly, I AM WELL AWARE OF THE INSTRUCTIONS. The IRS instructions state that they will acknowledge receipt of Form 1023 within 21 days of the mailing date, by letter. Since they haven't responded within the 21 days, I thought I would ask on this board.

    I prepared this application for my client, and the client mailed it to the IRS on 12/26/08. No response yet. Anybody have an idea how long it takes the IRS to either issue the determination letter or request additional info from the client? The last Form 1023 I prepared was about 5 years ago.
  5. Schedule EIC is not required for an EIC eligible individual with no children. The "NO" automatically is placed on the appropriate line when the person is eligible for the EIC, but has no children. The program has always done that.

  8. jklcpa, I would go ahead and include it even if its not required. That way, you can keep a record of the assets that you mentioned. Just because the 4562 isn't required, doesn't mean you CAN'T include it.

  15. Thanks for your responses. Has anybody been able to create an e-file with BOTH forms 8829 and 4562 yet? I know that I have the most recent version of both forms.
  16. Let's assume that CA doesn't issue the tax refunds until late 2009. What I would advise employed people to do now would be to change their CA withholding certificates and have the MINIMUM amount withheld (whatever the minimum is). If CA is in financial trouble NOW, wait till they see the tax remittances go way down throughout the year.
  17. Just curious.....does the "common man" in CA have any recourse against the State's holding his/her money? The way things are, I can see other states doing this. Wait until the Feds start doing it.
  18. and got a message that Forms 4562 and 8829 were not approved yet for e-filing. I checked on the MyATX site, but I couldn't find anything that says when the above forms would be approved for e-filing. Any suggestions??
  19. Tried to create an e-file this AM. The program is telling me that Forms 4562 and 8829 have not been approved for e-filing yet. Tried to find out info regarding this by logging on to MyATX, but no help. Where can we find out when these forms will be approved for e-filing??
  20. Thanks, Evan. Now, forget about the S Corp. If a C Corp has only one class of stock o/standing, and has 3 shareholders. In this scenario, can the Corp pay dividends to only one shareholder? I seem to recall that if one stockholder (in the above scenario) receives a dividend, then all shareholders have to, based upon their shares held.
  21. My mind is not working this AM. If S Corp has 3 shareholders, can Corp pay dividends to only 1 and not the other 2?.

  23. I ended up with an older woman at a club last night. She looked pretty good for a 60-year old. In fact, she wasn't too bad at all, and I found myself thinking that she probably had a really hot daughter. We drank a bit more and we had a bit of a snuggle, then she asked if I ever had a "Sportsman's Double?". What's that? I asked. It's a mother and daughter threesome, she said. Oh. I said as my mind began to embrace the idea. No, I haven't. And I wondered what this daughter of hers might look like. We drank a bit more, then she said with a wink that tonight was "my lucky night". So I went back to her place, we walked in. She put on the hall light and shouted upstairs... MOM, YOU STILL AWAKE?
