Husband had health insurance for the whole year, wife didn't, to calculate the penalty, do I include wife's household income only or also include the husband? For some reason, I thought ATX picked up the appropriate income and we only had to include dependents income apart from the parents.

Are any of the meals business related? For example, bringing in doughnuts, coffee etc.... for the clients that cut the check? We always have bankers send us goodies to our office.

You’re uninsured for only 1 or 2 consecutive months of the year
1. Under shared responsibility, do I have check off the two months? If yes, I am getting a 16 penalty in this case.
2. Forgot shared responsibility and go to individual exemptions and check "B" short coverage gap? No penalty in this case.

There is this form, unfortunately I can't remember the form number, but basically you let the IRS know the account is not under the TP name but you are claiming it and letting them know.

Does form 3115 have to be prepared if you are not making any of the following changes:
The treatment of an asset from nondepreciable to depreciable or vice versa.
Change to the depreciation method, recovery period or convention of a MACRS asset.
Change from improperly expensing to capitalizing an asset.
Or do you simply elect the Safe Habor and forget about form 3115?

Ok I went ahead and claimed unfordable and the penalty disappeared, but my concern is that TP did not get health insurance not because he couldn't afford it, he could of went with medicaid, but because he didn't know he had to have it.
The penalty is correct according to the worksheet, in this case it's a family of 3, one adult and two kids under 18, total penalty is $195.00, kids are elementary students and don't work, total income for the family is approx. $20K.
