1099 Misc Box C for Employer Paid Insurance

Me too. That is why I asked here. It is a life insurance policy is all I got when I asked the question. I would have expected it to go to box 12 code W (I think that is the code), but maybe not because it is probably not term insurance and that is what that code is for. This is a new one on me. I think I will stick it on line 21 and see if it flies. If I am wrong, it will cost the Medicare and Medicare add on (already subject to that one). Thanks for your responses. Tom Newark, CA -
Sorry but I disagree. While I have used that argument (not in the trade or business) successfully in one audit, providing labor to a business for cash from that business is SE all the way in my book. As soon as the business sends the 1099 Misc, you got a trade or profession that a business was willing to pay you to do. I know I am in the minority here. Tom Newark, CA

Posting Again - Help Please - CA LLC disregarded

Yes, U(1) is answered yes. But when I hit the "Check Return" button, it says a Federal 1120 return must have been previously transmitted or transmitted with the return. It is a Yellow error, not red, but I don't know how to get around that. What did you do...and thanks so much for walking me through this. Also, I want to file a CA LLC- 4/7 form with it to dissolve. Can that form be efiled with the return or does It need to be mailed with a wet signature? Tom Newark, CA -
I am posting again because this return is driving me crazy and I am not sure how to do this in ATX. Client formed an LLC for the purpose of doing some consulting work on the side. The gig never materialized. He has an LLC that is a disregarded entity for federal tax in 2016 that has nothing but Zero's and the $800 CA LLC fee due. I am trying to just prepare the CA return because he has no federal filing requirement. That is not working out so well. The 568 wants to attach to something in the Federal Return. Do I add the 568 to his Federal 1040 Return so that the 568 has something federal attached to it? Then create a Schedule C that has nothing on it? I hope not because I have already sent the 1040/540 off to e-file heaven. I have never done a 568 that was a disregarded entity for Federal tax. I have done plenty that were Partnerships and S Corps. This has me very stumped and I could use some help. And I am sure if I try to efile it I am going to get an error that the Fed Return must have been filed prior to sending the CA. Do I just paper file the 568 with no federal return attached and go with that? Thanks in advance. Tom Newark, CA

My Client is a Highly Compensated Employee. in 2015 he moved into executive management in the company and they paid for a life insurance policy for him. I did not know this in 2015. In 2016, he sends me his stuff and there are 2 1099MISC with box 3 Amount of $4400 for each year, one for 2015 and one for 2016. There is an amendment coming for 2015. Question is - Does this go to line 21 and no SE tax? I have never seen this before. Does it make a difference that he is over the top for SS? Thanks Tom Newark, CA

I am trying to add a home office for the spouse on the tax return. She is a Tele-commuter for her company. When I try to put the home office in, I get the choice of the Sch A, but it says Joint. When I choose the schedule A, the home office shows up under the husband. How do I get this home office deduction to show up under the spouse column. The husband has a separate home office for his schedule C real estate business, which is why I want it to show up in the correct column. Thanks Tom Newark, CA

It is still in the tax code. Are you going to risk your license? To each their own, but until the Treasury writes new regulations, I will ask the appropriate questions and make relevant inquiries of my clients for the positions they take on the tax return. Including the penalty tax related to the ACA. I will not sign my name to a tax return that I know to include false information. Tom Newark, CA

What are you all going to do when a client comes in and says they heard this on the news and they are not going to pay the penalty? We discussed it at my office (OK, wife and I discussed) and we decided that the law is still the law and until the penalty tax is removed from the tax code, we are going to file the return according to the tax code. If they want to walk to a big box that is up to them. I hate losing clients, but this crap just doesn't feel right to me. I just can't stomach the whole mess this thing has become. Tom Newark, CA

I am filling out a 4852. I wish they had a magic button that would transfer the information into the W2. It seems like such a waste of time to put the exact same information into the software 3 times (Fed 4582, CA 3525 and the W2). Is it just me or is this a no brainer that the software should do this. What gfizer said...except I don't quote the price up front. I tell all my new clients that they can see (but not take) my price list. Whatever forms that the tax return generates will be charged for. I also tell them that if they don't like the price I will take my tax return back and they can have their documents back and we can both go our own way with no hard feelings. I don't want unhappy clients, but I feel my prices are fair so I am not negotiating after the fact. This reminds me of my Econ Professor, Mr. Yergi. He taught us the "Prostitution Principle of Economics". The value of a service declines immediately after it is provided so service businesses should always get paid before the service is rendered. That is why hookers get paid up front. You should have seen the shocked looks on the faces of my classmates when that lecture happened. Still brings a smile to my face when I remember that lesson. I never click on links (as many of you here know - even on this board I am very careful). So I hit the reply button and very politely explained that if there was a charge by my company on his card he should send the information in the body of the email. The reply email was undeliverable, meaning this was a scam. There was nothing in the email header to tip me off that this was not a legitimate email. It was only the link in the message that sent up my radar on this one. Be careful out there folks. It is getting harder and harder to see this crap. Remember when it was only the African princes who needed us to cash their checks for them? It ain't like that no more. Tom Newark, CA

I am just reading this thread for the first time right now. I got the red error when checking the return this morning. Did not try to efile without it because I just forgot to check the box on line 61. Assume it would not have let me create the efile with that red error. I update every time I open the software. I have a new client who has one of those "Oh by the way..." comments after we talk about his personal taxes. I need to do a more thorough follow up interview because it caught me off guard and I did not ask all the right questions when he asked his "quick question". Taxpayer is planning to do some consulting work for a company. He formed a CA SMLLC in May on LegalZoom. Did not get a Fed EIN. Has done no work at all as the plans for the consulting engagement have not come through yet. I believe what I need to file is a FTB 568 al by itself with all zeros and pay the $800 LLC fee. It seems strange to have a CA return without a Fed return. Am I correct on this? Then it hit me last night, that professional service companies are not allowed to operate as LLC's in CA. If this guy's consulting business is professional, he can't be an LLC. If that is the case, then I think CA will still want a first and final return and he needs to close the LLC with the SOS. Thanks Ryan, I tried that and it only gave me the option to look for 1040 or Business returns(1120, 1065 etc.). The taxpayer has not filed 1040 tax returns, but he tells me he has filed the 941's and the 940's. I don't see an option to pull the PR return transcripts, which is what I am looking for. If you don't mind, could you elaborate on where to find those transcripts? Thanks for taking the time. If I can get this from the website it will save me a ton of time. Tom Newark, CA
