Trust me when I say that the WHOLE company at ATX is consumed and driven to release a dependable, working product. The conversations I had at the CAB were deep and revealed to me their dedication to do it right. Lots of new faces, several old faces gone and an entirely different attitude. Stand by, I will give you my recommendations as soon as I have done as much testing as they will allow me to do. When I decide, you can rest assured I will have viable and extensively explained reasons for my recommendations.

I repeat what I posted earlier. Unless an OIC is accepted, the owners will ALWAYS owe the trust fund monies. It is/was NOT THEIRS. The penalties may go away, but the trust fund taxes owed will not. Not even bankruptcy. Shame on the IRS for allowing the owners to miss out on more penalty that they are claiming they can't pay anyway. I had an employer abscond with $2,500 of my money. Cannot get SS credit for the money he kept. IRS allowed income taxes deducted because I had a paystub. This is why I have NO SYMPATHY for trust fund embezzlers. This is exactly what they have done.

This only applies to a company provided 401K for the company he works for. IRA must distribute RMD. As long as the taxpayer has earned income equal to or above the amount he wishes to contribute, he can do so.

An OIC has a very slim chance due to it being trust fund money. The IRS will also seek to make the taxpayers personally liable and attach bank accounts and levy assets accordingly. That is what happened to my clients until they paid in full.

I had a client with similar issues where their previous accountant dropped the ball big time. Three attempts with letters to get penalties abated was to no avail. This was in 2010 The IRS has become stiff-necked concerning anything with trust fund money.

This answer is NOT COMPLETE. There is a total shutdown of e-filing at the end of every tax season, sometime in October. However, on Jan 15, 2013, any MEF compliant 2011 tax return was able to be e-filed and currently can be until the annual shutdown. I have e-filed a dozen 2011 returns this year and 3 2010 returns. The IRS will support e-file for three years. Starting Jan. 15, 2014, any MEF compliant tax returns for tax years 2011, 2012 & 2013. This is dependent, of course, on the actions or inactions of the Congress at the end of this year.

Any 2011 return that meets MEF requirements can be e-filed. When you create the e-file, it will tell you if it qualifies.

The original joke is more about the absolutely atrocious condition of mental health diagnosis and treatment. Am I the only one that sees that? Roses are Red, Violets are Blue; I'm a schizophrenic, And I am too. BTW, sanity is overrated!!

I have been exactly where you are. 7004 is not the correct extension. Form 8868 is the correct one. I took care of a CRUT for 5 years and filed extension form 7004 for four of them. No problems with the first 4. 2011 tax year, the last year (owners died of old age in early 2012) I did it, filed the 7004. Filed return August 2012. Clients estate received the same notice with over $4K of penalties. I wrote a response with all the documentation of the previous 4 years, and IRS abated the penalties. Not sure if this information will help.
