  1. About 50% of my practice is EITC returns. I do not listen to the complaints and I say to them the refund is the refund. I have been doing this for 13 years and will not be drawn into the clients problems.
  2. The information is put on the OSC form. You must also attach the other states return.
  3. You must attach the resident state tax return and check the NR box on the OSC. I use TW but I assume it is the same. Most of my claims the people live in MD.
  4. I use Fujitsu fi-6130 very fast and good. Have not found a good software yet that is why I am not 100% digital.
  5. I knocked on the door of seventy two years ago also and would look to HRB when time to sell. I have 1700 clients of which only about 250 are personal. I would be happy to br able to receive all my money in one transaction.
  6. I do not think any one will write the insurance once he is in a nursing home.I tried to obtain it when my mother in law was 85 and in good health no one would write the policy that was cost efficient.
  7. I have been able to abate under-reporting/under paying penalties on the same type of incident. The early distribution penalty must be paid.
  8. On the federal side you should be able to have the penalties waived under FIRST TIME ABATEMENT. I do not know about the state. I have paid interest and state penalties for clients when I was positive the mistake was mine.I have also split these items when I felt It was also partly client's fault.I have never used my E&O insurance.
  9. Client can obtain new ID theft pin @http://www.irs.gov/uac/Get-An-Identity-Protection-PIN. Did it several times during tax season not difficult.
  10. No it is not the same thing. RALS were loans and had high interest rates.RACS are a way for people who do not have bank accounts or the money to pay for their returns to receive the refunds by direct deposit.
  11. Does the client still work for the company that she has the 401K with? If she does there is no RMD till she retires. Tax Book page13-23
  12. I have nine preparers all but one part time. I pay them $11.00 per hour plus $10.50 per return.It is more than the JH & liberty. Most of the returns are basic EITC returns. I have had very little turn over in the last 12 years so they must feel it is fair.
  13. Return can be e-filed.Make sure he did not do a rollover.
  14. Each office requires it's own EFIN. You may cause yourself problems in the future.
  15. I do not know what call cnter they are talking about it was almost impossible to get thru in the begining of the season.
  16. She can file the FAFSA with out him. My wife filed it with out me for my step children for years.I paid for college but we received more money with out me. As a step father I did not have to show.We went to an education consultant help us.
  17. In MD there is nothing to file.It works off the Federal.Have you been filing MD personal property tax form and paying the $300 each year?
  18. Will go to DC and take a couple of my preparers.It is about two miles from my office.

I have one location and a home office.We did 1750 returns last year down from almost 2300 the year before.The JHW store 5 doors from me does the same verification.It is built into their software.The HRB is 3 miles away not much compettition.Two Instant Tax that were my biggest problems are now out of business but may open under differen names.They did pay stub returns for years.

As I had said before if you do not due at least 150 EITC returns you have no major worries.They want only the people who actually take care of the child receiving EITC.I told many of the clients who could not provide birth cetificates to go to court and adopt the child or go to family services and have the child placed with them.I will see if they return this year if they followed thru.I am in Oxon Hill which borders SE DC where unemployment is over 25%.
  21. The main answers are Mother in jail,disapeared,in rehab,dead.Farther unknown.Preparer had done 250 returns 150 EITC.Since we have asked for birth cetificates lost over 500 returns.
  22. The EITC was not disallowed, but the preparer was audited. The auditor said for due diligence we had to check birth certificates of dependents that are not son or daughter if EITC claimed. Lost at appeals. You can not take preparer penalties to tax court. You file 6118, when that is turned down, you go to Federal District court. Which is where the case is now.

There are few written rules for EITC due diligence.In an audit you must prove that you exercised due diligence.The last audit which I lost in appeals I am going to district court.Know where does it say you must have birth cetificates to prove dependents other than son or daughter.The fine is $17,000.IRS took the preparers refund this year
  24. If the 8867 is not signed you have no proof that you asked the questions.This is from the mouth of two EITC auditors.

Having handeled three EITC audits for preparers that work for me the last two they only checked returns that had nieces,nephews,brothers ,sisters and grandchild.You had to have copies of birth certificates to prove the status claimed.They also wanted proof that the child lived in the household.They looked at the 8867 and it had to be signed to prove you asked the questions.All three preparers had done more than 150 EITC returns. In talking to other preparers that have been audited all had done over 150 EITC returns.
