It is true, however, that any program that is forms based needs a user who understands which form to select, and when, while the input sheet type program makes that decision based on answers to the questions. Of course, that is also why the TurboTax self prepared returns often have serious errors, since if the person answering the questions does not understand the reason for the question, they may easily answer incorrectly. It's the reason why the chains like the input sheet programs, and why so many of us old codgers like ATX.

The very fact that she is paying a set salary says this is an 'employee'. Yes, the commission is part of the wages, it's just a method of calculating the amount, it's still 'wages'. No difference on the W-2 at all. The benefit of being 'statutory' employee is that they get to deduct their EXPENSES on a Sch C rather than get the 2% haircut on the Sch A. The employer still pays the payroll taxes just like a commonlaw employee. You don't even need to know how much is 'commissions', really. The only 'commissions' that you report on the employer's Sch C are commissions paid to other agents not under her employ. Everything she pays this employee will be on the Wages line. The insurance industry was just smart enough to lobby Congress to acknowledge that in their business, their employees are commonly paid in all or mostly commissions on sales, and that the sales people have to put in a fair amount of expenses on their own, to generate those sales to earn those commissions. And thus the 2106 would be an unfair treatment. So they got Congress to allow this hybrid situation. It's the same for 'outside sales' reps, for the same reason.

I think we all need to think about this in future, before we sell or trade any copier or scanner that we have used in our business. Imagine if one of those had come from a large H&R office? I no longer use a copier, just printers and scanners, but I will not sell any old machine without having the hard drive erased or removed. And the 'erase' will be a full security erase, not just a 'delete files' but a full erase followed by reformating the drive.

You are certainly welcome to stay and contribute here. And I imagine if a significant number use it, there will be useful software-specific info here, as well. We started off all-ATX, but now have a significant number of Drake users, for example. But all of us share the same tax issues, and often the answer to a question that appears to be a software question, is at least partially a tax question, instead. I for one did buy from TRX last year, but will not this year. I'm very leery, too, of any company that promises to keep a price the same FOREVER. That is just not realistic. It's a false promise, because no-one can project that far into the future. I'm not willing to switch programs unless the reasons are more than just price, or the price of my software just becomes totally unreasonable. I also have to consider other factors. In my personal case, health and other considerations may well limit my ability to continue to practice many more years. It does not make sense FOR ME to learn a whole new program, unless the program is not only a lot cheaper, but also better. Otherwise, it makes more sense to just raise my prices a bit to cover the difference. If someone has a very small number of clients, and is not pressed for time to do the work they have, it might be smart to change. But if you have 300 clients, and are very busy during the 'season', a difference of $900 would be only an extra $3 per return, and the extra time to convert, and to become familiar with the new software, would make it foolish, IMHO. Everyone is different, so it is not a matter of one side being right and the other being wrong. Those who stay with ATX and those who change will hopefully both be right, for their situation. I just hope that you all stay on this board, either way.

On April 15th the House passes a bill that will remove cell phones from listed property category by amendiong IRC 280F(d)(4) effective for years beginning after 12/31/09. This is in H.R. 4994 "Taxpayer Assistance Act of 2010." Let's hope this bit gets into the final bill. It's way past time.

I used to have a pastor with very similar situation, [he has since died], who was semi-retired, lived on his savings mostly, but preached for a small country church that only provided the parsonage, no salary, because he did not want them to pay him. That was before efile, but the IRS did not have a problem with taking his check for the SE tax, even tho at 73 he was not going to get anything for it that he was not already entitled to. But he kept the amount to a minimun. I remember in his last year he owed less than $10., all SE tax.

I thought Tom was very polite, and even informative, in his response. Yes, he did discourgage the use of this board for someone looking for free advice for a self-prepared return. Which is not what we want this board to be used for. But after informing her of that, he did still give her good advice on both how to 'do it herself' and also that her preparer should and likely would file the 1040X for her, if in fact, she did qualify. For all we know, that preparer had already checked the various websites, and found that she had, in fact, already received the credit. -

Sometimes I'll look down at my watch 3 consecutive times and still not know what time it is. 32. Even under ideal conditions people have trouble locating their car keys in a pocket, finding their cell phone, and Pinning the Tail on the Donkey - but I'd bet my butt everyone can find and push the snooze button from 3 feet away, in about 1.7 seconds, eyes closed, first time, every time!

Main question would be would it make a difference on the 1040s, not in the total but in the characterazation of the type of income? It could be significant to AMT issues, for example. That's what you have to consider. I think if it affects even one partner that way, you have to amend it.

Actually, I usually complain more about those US citizens who don't want to work than I ever do about illegals. It really irritates me that so many people want to take from the government [which means take from the people who work and pay taxes], but don't want to contribute, drop out of school then complain that they can't get a good job, etc. On the other hand, I do want the foreign workers to come here legally, and I do want them, if they want to stay, to learn English and respect our country and our flag. If they want to wave their home country's flag, that's fine, they should just do that in their own country. Honestly, if they come here because here is better than back in their own country, shouldn't they respect us for offering them a better life?

I bought a bird feeder. I hung it on my back porch and filled it with seed. What a beauty of a bird feeder it was, as I filled it lovingly with seed. Within a week we had hundreds of birds taking advantage of the continuous flow of free and easily accessible food. But then the birds started building nests in the boards of the patio, above the table,and next to the barbecue. Then came the poop. It was everywhere: on the patio tile, the chairs, the table. Everywhere! Then some of the birds turned mean. They would dive bomb me and try to peck me even though I had fed them out of my own pocket. And other birds were boisterous and loud.They sat on the feeder and squawked and screamed at all hours of the day and night and demanded that I fill it when it got low on food. After a while, I couldn't even sit on my own back porch anymore. So I took down the bird feeder and in three days the birds were gone.. I cleaned up their mess and took down the many nests they had built all over the patio. Soon, the back yard was like it used to be, quiet, serene and no one demanding their rights to a free meal. Now let's see. Our government gives out free food, subsidized housing, free medical care, free education and allows anyone born here to be an automatic citizen. Then the illegals came by the tens of thousands. Suddenly,our taxes went up to pay for free services; small apartments are housing 5 families; you have to wait 6 hours to be seen by an emergency room doctor. Your child's 2nd grade class is behind other schools because over half the class doesn't speak English. Corn flakes now come in a bilingual box; I have to 'press one' to hear my bank talk to me in English, and people waving flags other than 'Old Glory' are squawking and screaming in the streets, demanding more rights and free liberties. Just my opinion, but maybe it's time for the government to take down the bird feeder. If you agree, pass it on.. If not, continue cleaning up the poop!

I am trying to warn all the men that I know!!! Women often receive warnings about protecting themselves at the mall and in dark parking lots, etc. This is the first warning I have seen for men. I wanted to pass it on in case you haven't heard about it. A 'heads up' for those men who may be regular Lowe's or Home Depot customers. This one caught me by surprise. Over the last month I became a victim of a clever scam while out shopping. Simply going out to get supplies has turned out to be quite traumatic. Don't be naive enough to think it couldn't happen to you or your friends. Here's how the scam works: Two seriously good-looking 20-something girls come over to your car as you are packing your shopping into the trunk. They both start wiping your windshield with a rag and Windex, with their breasts almost falling out of their skimpy T-shirts. It is impossible not to look. When you thank them and offer them a tip, they say, 'No' and instead ask you for a ride to McDonald's. You agree and they get into the back seat. On the way, they start undressing. Then one of them climbs over into the front seat and starts crawling all over you, while the other one steals your wallet. I had my wallet stolen June 4th, 9th, 10th, twice on the 15th, 17th, 20th, 24th, & 29th. Also July 1st & 4th, twice on the 8th, 16th, 23rd, 26th & 28th, three times last Monday and very likely again this upcoming weekend. So tell your friends to be careful. What a horrible way to take advantage of older men. Warn your friends to be vigilant. If your memory is bad, write it down to remember this trick! Wal-Mart has wallets on sale for $2.99 each. I found cheaper ones for $1.99 at Dollar General and the Dollar Store and bought them out. Also, you never will get to eat at McDonald's. I've already lost 11 pounds just running back and forth to Lowe's and Home Depot. Did you check which printer you were printing to? Try changing the printer choice, and see if that makes a difference. Maybe print to the pdffactory printer and then print that pdf to your normal printer?

I agree, Line 21, no SE tax issues here. He can not take his expenses, unless that was what the payment was for. In which case you could deduct them against the income, and I would do that on line 21 also.

That statement is, I believe, considered a 'substitute W-2G. So I'd just enter it as one item. Keep a copy of that, but you do not need to send it in, the IRS gets their copy from the casino company. If they should have a question about it, that will be soon enough to send it to them.

Well, we don't know enough details to say for certain, but it would certainly be legal if the boy provided over half his own support. Which at 7K is possible. My biggest question would be 'where did the son live?' If he lived at home, that alone is support from his parents. But yes, if the son did in fact provide at least half his own support, then it would be legal to amend it, in fact it would be the right thing to do. I suggest you do a support worksheet to determine that.
