I have to point out that YOU are the only one who has used that sort of talk, Montana. One thing that I especially liked in the last thread was that no one did descend to calling names. I did remove the thread, because it had started to get repetitive, and because it bothered you so much, but I think there was some good [and polite] debate before that. And since I started that thread, I do take just a bit of offense that you are saying that I was "calling the Democrats or Obama a bunch of unprincipled, stupid, dirty rotten scum." I would never do that. It WAS about the use of the tax code to raise the money for the social programs the President is pushing, and that is something that I think will always be a legitimate subject on this group. I'll put Politics in the heading in future, and you can then skip the thread. But please do not accuse those you disagree with of name-calling, just because you do not like the light that the facts put on the pols behind it. Just naming the party behind a policy is NOT calling them the names you used.

Rita, if you have 20 years to retirement, it makes sense to be buying, as long as you buy conservatively. I'd go for well managed companies that sell things that will be selling even in hard times. Proctor & Gamble comes to mind. WalMart also. Johnson & Johnson. You get the idea. There are real bargains now, and I don't believe that any President or Party can totally bring down this country. DC may be crazy right now, but in two years we will have the opportunity to replace the ENTIRE CONGRESS, and I would not be surprised if that was what happened. I can not believe that the 'real people' who's work is what fuels this nation will stand for much more of what is going on now. And if we clean house in two years, we will start recovering pretty fast.

I've used their Drivers License for the ID. Perhaps your client could fax you a copy of that? There is a FeeCollect authorization that has to be signed, the same form that asks for the ID on page 2. Also there is a Consent to Disclose and a Consent to Use. Those forms you fill in a pin number, and print them, but they do not have to be signed. That's it, other than the 8879, and state form if required.

I'm not certain, but I think that means that YOU have not updated your EFIN for business returns. You can do that online through eServices, or by calling the efile help desk and they can update you on the phone.

Another factor that might favor the conversion is if he does not need the money. Traditional IRA must start distributions at 70½ whether needed or not. Roth does not have to ever be taken out. And Roth is nontaxable to heirs. So depending on the situation, that could be a plus or a minus.

Bet that is going to make a lot of people who are trying to sell their current homes mad, since it gives a big incentive to buy a new home instead of an older one. Is it only for first time buyers? Or can anyone who buys a new 'replacement' house get in on this deal?

No, and your example just illustrates how wrong that is. If a client of mine is in danger because of something an employee of mine did, you better believe I'm going to cooperate with the police as fast as possible, to stop harm to my clients. How would you feel if you found out that a crime against you would have been blocked from happening, except that the employer of the thief delayed the police in apprehending him, or notifying you so that you could protect yourself or your assets?

Yes, they did receive the money. BUT, if you get a LOAN, that is not taxable income. Nor is the repayment deductible. So it is wrong for him to be thrown into the higher tax bracket because of a loan. That is the real consequence that Joel is trying to avoid. If the mistake had not been discovered until later, the treatment would be as you describe. But since the mistake was found, and converted, in the same year, they really should have corrected the W-2. Joel is trying to correct that error. It's a gray area, but I'm with Joel on siding with what actually occured. -

I agree with Jack, there is nothing at all that prohibits anyone from naming someone as a client, they are only prohibited from disclosing that client's tax information.

Well, you have the form now. And I expect she visits you so much because she is lonely, RC. People that age have already lost most of their contemporaries, and now have to find someone who is willing to talk to them. Just remember, you will probably loss her soon, and then you will be sorry not to have her visit, once she dies. Think of it as a charitable deed, to give her a bit of your time. Maybe that will make it easier. I had one just like her, and now I miss her!

Why don't you print it in both, then send it to the client directly? You must have his address in your files, after all.

But that is exactly why the company puts more programmers on the most used forms, first. After all, this form is optional for the majority of those who have foreign taxes, and most of those who do need to use it are still waiting for their K-1s, etc. I've never had to wait long for any basic form, except the year that Congress changed them on Dec 26th. And that was not the software company's fault, and affected all software.

Yes. It seems unreasonable, but that is how the law was written. He gets the 'loan' treatment, for purchase in 08, of course.

Of course, I agree with you, Joe. I was assuming that it was a monthly pension, but if it was a single payout, it would all be reported to whichever state he was a resident of at the time. Or if it was two or three payouts, then based on when and where.
