  3. So do I! I have had clients with exchanges of out of state property for Oregon property, but not vice versa. Oregon wants to make sure that somewhere down the road the source of income is not forgotten! Oregon also has a a form 18-WC that can require escrow agents to withhold Oregon tax when property is sold to non-residence at a gain.

  4. I use ATX. Form 7206 shows up in the return. For Self Employed Health Insurance Deduction. My client is a W2 employee, no self employed income. I discarded the form and when I save and check the return, the form is added back into the return. It doesn't prevent me from creating the efile. But the form is included in the efile forms list. I haven't had this form even for other clients who are self employed and take the health insurance deduction. I simply go to the Statement 1 line for the deduction. Does anyone know what this form does and why it shows up in my client return?

  5. I had this form show up in one of my SE returns for the first time today as well. In my case, I had used the worksheet linked to Schedule 1, Line 17 to enter the amount of the premiums and then when I saved the return this form showed up. As I understand it from a quick google search, it is a new form for use in calculating the self-employed health insurance deduction and according to ATX should be attached as a pdf to the e-filed return. I haven't seen it in any of my non-SE returns....yet.

  6. This works as well. In my case, the culprit is Avast. My IT person went into Avast and turned off the files that were not allowing ATX to open. This now prevents me from having to turn off Avast every time that I want to log into ATX.

  7. It can be submitted online. I stumbled over the requirement to file the form that doesn't mean the nonresident does not have a filing requirement (but has to file this form). I think I have it now! Still baffled about the CA required insurance but managed to get it down to $256. I really just want to stick with Ohio returns which are bad enough!

  8. Sounds to me like your client had Oregon Source Income per ORS 316.127 (2)(a) and needs to file Oregon Form 40-N.

  12. What is the name of the Trust? I use 5227 every year for a CRUT "Charitable Remainder UniTrust". The answer to your question lies within the type of trust you are dealing with. Split interest trusts, charitable lead trusts are also required to file form 5227. BTW- Form 5227 is usually combined with form 1041. If you are using Drake they are both considered fiduciary returns. In my case, while certain information from the input screens flow to the form 1041 and associated forms, I don't file them and just ignore them. There is no way to delete them from the return. These things are not eligible for efile and get mailed anyway.

  14. Margaret, The reason you are confused is because CA tax is confusing. They want you to recalculate the federal return as if you were a resident for the entire year, then make adjustments on the CA 540 CA form for items not taxable by CA. They prorate the deductions and the taxes based on the percentage of income earned in CA. As for the 3858, I think you have it right. She was in the state and did not have health coverage the entire time. Sorry so late chiming in, I have been super busy and not been able to look at the board much. Tom Longview, TX
