  1. I thought the idea of no late penalty if you are getting a refund was decided by the tax courts long ago. Am I mis-informed? The idea being that if a refund is due, all taxes have been paid. Hence, no late filing or payment penalties.

  6. ATX does EIC correctly if all inputs are done correctly. There have been many times ATX did not allow EIC that the reason was not obvious. Upon further research, we found that ATX was correct.

  12. Paycheck dates MATTER if the IRS looks. And in this situation, they WOULD look. Payroll cannot be back-dated. It has to be "constructively received" in the year it is claimed as expense. I think the work "fraudulent" would fit here. If the preparer is knowledgeable of this, and they choose to go forward with it, they will be as liable as the company owners. If the S-Corp owner had consulted with an experienced and ethical tax preparer, you would not even be asking this question.

This special 50-minute session will be a unique opportunity to hear remarks from the current IRS Commissioner. I will spend that time in the exhibit hall!!

I have been up to my ears trying to solve the issue, and any input from you will be helpful. Yesterday, I spent over an hour implementing some procedures they recommended.   22. The slowest SSD is exponentially faster than any mechanical hard drive. You would be comparing the pole sitter at Indy with the person in 33rd spot. Somewhat slower, but still fast as hell!!
  23. The attitude of most IRS people we deal with these days is abysmal. As tax professionals, we are considered about the same level as the goo at the bottom of the crude oil tanks.
