  6. Your client has two choices: MFJ or MFS. Both of them need an ITIN to process. You could request an ITIN, report the global income for both and attach a letter signed by both stating that the non-resident wife wants to be taxed as a resident.

  8. I would amend all 3 years. Who will appear on the top of the 1040X? I will recreate his/her 1040 as it was filed. I will make sure everything matches, save it and then invoke the "amend return" command by pulling down the file menu. Then I would add the spouse's name and then I would add their income and print the new 1040X. Don't forget to include the explanation on page of 1040X.
  9. Based on this, I have no choice than to use my current EFIN and the new entity will report a short year and losses. It doesn't make any sense to register it now if I can wait until July.
  10. Currently I have a sole proprietorship named SOLOPERDEDOR and the efile number is under that sole proprietorship. I pay my friend for using her office and some of her equipment and internet access. I want to form an LLC and make her a 25% member. I want to register the LLC on Monday (Jan 6), but the ATX software under the LLC but I will not be able to get the efile number for this tax season. So I will be forced to continue using the old efile number but I will start putting the money I am charging on the LLC. I will apply for efile number under the LLC next week but it won't be ready for this tax season. Should I wait until the tax season is over and register the LLC at that time? So my taxes for 2014 will have Sch C with profits and the K1 will reflect losses.
  11. For that computer, that hard drive is wide open. You should have 0 issues accessing ATX due to the encryption.

  14. Kea, You can use bitlocker which is a MS product built in with Win7 pro and other flavors. Make sure you have the recovery key in a safe place and handy. If you have issues, you can decrypt or un-encrypt the hard drive and go back to where you are now. Again, if you are using a stand alone computer, you shouldn't have any issues. You will be delayed only about 45 seconds everyday.
  15. What's encryption? For a stand alone computer, it is just an extra layer of security that doesn't interfere with the rest of the operation. It will cause a lot of headaches to network environments if you don't know much of what you are doing. Another issue is to have MACs and IBM-compatible computers with different encryptions on the same network. Again, if you don't know what you are doing, be careful with network installs but don't be afraid if you only have one computer. What encryption does is to add a seal to the hard drive and the only way to open up the hard drive is with your encryption password. Once that password has been entered, the hard drive is open for business just like any other hard drive. So, rolling over returns on the same computer from year to year is not an issue because the only hard drive you use is as open as the unencrypted one you are using. So, if your unencrypted hard drive is stolen (or your computer), anyone can connect the hard drive to a computer and read the data in it. If the hard drive is encrypted, they will have to have your encryption pin or password to open it and the other computer will need to have the encryption software installed in order to read the hard drive. If your computer or hard drive breaks, the only way to read your data from the hard drive is with another computer with the same encryption and your encryption password or pin (key). So, don't be afraid to encrypt your hard drive if you only have one computer.
  16. Report who? Someone charged them big bucks to have the return prepared but at the end of the day, the return was "self prepared". Also, they know the preparer by Salomon and that's all the info they have. People who go to these places to have their taxes prepared, go there precisely because that's the kind of preparer they like. As soon as I see a return self prepared and they mention a famous guy in DC (now in MD), I tell them. I doubt you will hire me to prepare your taxes because you are used to preparers that don't do a good job. I don't waste much time with them and most of the time I recommend HR block. I honestly like to get clients from HR block because I can charge my "new client" fees without any discounts.

  18. For testing, make a user of a workstation admin to the server. If that solves your problem, then you know it is a permissions issues. Remove the user from the admin group and give him permissions. You have to give share permissions to the folder and also you have to give access permission to the folder. Keep in mind that you will need two kinds of permissions and that making the user admin makes him the king of the server and has access to everything, locally or remotely.

  20. Double taxation of 0 is not a lot. Keep in mind that if you file 1120, all payroll taxes are late.
  21. I know we should not charge by the amount of refund but the penalty is $500 per EIC that you don't have adequate records. So technically, we should charge a lot more for a return that includes EIC form, but how about the ones that only get $5 as EIC? If you prepare 600 of those claims, you are not likely to be checked by the IRS, but if you prepare 600 returns with $4000 EIC claims on each return, you are likely to be questioned. So, let's say that I charge a flat rate of $200 per EIC form. Let's say that I charge $100 to a client if they simply want to know if they qualify for EIC. So, a client would pay me $100 to find out that the EIC will be only $5. If he wants to claim those $5, he will have to pay me another $100 because the IRS mandates that I charge a flat rate for everybody. Paying me the extra $100 to claim $5 credit would not make any economic sense to the client. What do you think?

  23. Why don't you share your advice with us? Are you also required by your confidentiality agreement with ATX not to share a suggestion such as "before you uninstall and reinstall, please call customer service and they might be able to help you" or "back up these folders and make sure you update your program after installation before restoring your data".
  24. I have heard that the EIC penalties are harsh. So in my situation, I am trying to get more clients with more income and get rid of EIC claimants. So I would keep the engineers and fire the researchers with two kids. Unfortunately, I have a big percentage of EIC claimants and my market is destined to be like that.

Is it January 1st or 31st or even Jan 13th, 2014 when corporations can start filing their 1120 returns for 2013.
