    It makes sense that if ATX 2012 felt the CD, form 1040 for 2013 was a newer version and tried to upgrade it. That shouldn't happen but it has logic. Thank you for the warning.

    Where do you live? This sounds more magic than real. Why do you think leaving any "virus free" CD will cause that issue?
  3. For 2012, this happened when we changed the name of the return. For testing, please go to 2011 and rename that return (add a 2 to the name). Open it up in 2011 and close. Close 2011 and open 2012 and roll it over. Open it up and save it. Close 2012 and open 2013 and roll it over. Do you remember if you changed the name of this return in 2012?
  4. I normally don't upgrade my browser automatically, I am still using Win 7 and IE 9 and I think I will jump to 10 after tax season. I think you should wait for a little bit when IE is updated. If you update automatically, you will have glitches on IE AND on the websites you visit. Before installing Firefox, did you verify that you Java was correctly installed? Java offers that check for you. Go to IE add ons and make sure all java entries are enable on IE. If Firefox asked you to update your Java, most likely you didn't have the current version installed on your computer.
  5. Include both W-2s and use SS# on 1040. Don't forget to paper file it. (I guess you will have no choice if you enter the correct information on the W-2 input page). Depending on how much it worked using the ITIN, you might suggest to him to go to the SS Administration with W-2 and taxes so that he gets credit for his SS retirement. The IRS doesn't merge automatically, but most of the time, people don't care. My friend was on a payment plan under his ITIN and the next year he got a SS card and he qualified for EIC credit and got two big refund checks from the IRS while owing on the ITIN account.
  6. Can we educate the contractor who doesn't provide his info or can we educate your client? Tell them that they are not entitled to any deduction because they didn't follow procedures. Show them how much they would have saved if before writing that check they had asked for that info. This happens sometimes, they have a proposal from three companies, two of them that are established companies that will provide that information by default (pre-set condition). And then you have one that will do the job for less but will not provide that info easily. So your client takes this offer and sometimes they even tell them that they will not issue them a 1099. When they come to you, they tell you that the "guy doesn't want to provide that info". Most of the time, your client didn't call you to make sure what s/he is supposed to do until the following year when you are ready to prepare their taxes, which is too late.
  7. Do her return and send a 1099 to the owner of the establishment. Chances are she doesn't work in the same place for more than one year anyways.

  9. Most of my clients have more than one W-2 and very, very few have 1099-Rs. So, before I work on a return, my friend adds up all boxes 1, 2 and 17 using Excel. I get a hand written note with totals. I enter the info on the computer from their forms and if the grand totals match, I don't waste time checking that again. If the amounts don't match, I recheck my entry and I quietly fix any mistakes I made. If the mistake is on the paper, I ask my friend to double check the numbers until they match. It is interesting to see that most of the time, she thinks that she didn't make a mistake and gives me back the same amount. (As Mr. Pencil said, you most likely will see it the same way the second time). When she is not in the office, I add them up by hand myself and then I scramble the W-2s and I start entering on the computer. Sometimes, I add unemployment forms and I check the AGI against what she wrote down. If you think I have a second pair of eyes in the office, you will be surprised. I am happy when she only makes 3 mistake on every 10 clients. The good thing is that she makes the mistakes on her hand written piece of paper.
  10. If you have your computer very tight (security wise), you need to loose them up at least at the moment you do that update. Updating ATX will take about 10 minutes. Do you think you will be hacked in that lapse of time? Do you have any faith on your firewall and/or your antivirus programs to defend you for 10 minutes?
  11. I file taxes in February, enter that that person will contribute $5000 to the IRAs, client gets the refund in mid February and client opens IRA on April 10th. No issues.
  12. Parent will win the personal exemption for the child. Just enter "the numbers of months lived with" as 2 or 3. That will eliminate any bogus HH or EIC claims.
  13. I do very few corporation taxes and all of them have about 5 employees. So, they don't have to change anything regarding health insurance for their employees. This is what I am going to tell my clients, if they don't have insurance by March 31, they will have to pay a penalty of $95 per adult on their returns and half for each child. I will also explain that they should have insurance now but there are 3 months in a year that don't accumulate penalty. (Side note, no penalty for children with ITIN, correct?). I don't have to worry about the 1% because my clients make little money and make a lot of babies (some of them, most of them). I will suggest to go to the Obama care website and check it out. Most of them will want me to do it for them but I should not get involved with this, correct? Now, during tax season, I only prepare taxes and I don't do tax planning. Do I have to invest a lot of time explaining the Obama care if I am not doing or charging for tax planning? Please add to the list. Do you have a letter that we can add to the tax copies explaining something of this that you can share. I think the letter should start with "you didn't pay for tax planning but here you are and it is your responsibility to comply with "Obamacare"".
  14. Will you agree with this? Let's that this person play the whole night and each of the nights he won $200,000 dollars in little jackpots without requiring the casino to issue a W-2G. On night one, he started with $500 and he had $800 withheld and then he went to sleep with $1,000 after loosing $203,700. The other night that he played, he started with $1,000 and he won 222,000 and they withheld $4,000 and he went to sleep with 0 after loosing $223,000. What amount goes on line 22? The same $4,300. What's matters here is the beginning inventory, what you used for your personal use and the ending inventory. In this case, he had a beginning inventory, he didn't used any for his personal use, and we had the ending inventory.
  15. Lions have garras and they use them to defend themselves (claws). When a person has garra means that he/she can defend himself/herself. To fall in the garras of someone is another thing. That means that you have no way to escape.

  17. Yes, you can show the IRS that you started with $500 and that you end up with nothing. That's a record for the day. The court already said that it is not feasible to have one hand on your coins and insert them on the machine, pull the handle and then register you loss on the log with your other hand. This process will be done thousands of times on a day and you will need a couple of notebooks each day you gamble. I know you could argue that you can take your accountant to take notes, but the IRS agrees with the "daily record" without reporting each transaction on the log.

  19. I think before clicking post, we should re-read our comments and be gentle with other people. How many times do you think I have just closed IE and I am happy this forum doesn't autosave? I have done that many times and a couple of times I have forgotten to do that and I have included some "nice" comments (based on my point of view). One time, I think KC deleted one from me and I was happy for that.

  23. Actually, having a passport lost while she is in her country is not a REALLY bad thing. She can get one in no time. When people are here in the US and they have entered with a VISA, I really don't like to send a passport to the IRS because the visa is lost if the passport is misplaced.
  24. In this case, he has records since he withdrew the money and he has the beginning amount and the end amount. He has bank records. Just out of curiosity, why drinking was mentioned? I would have done the same without any alcohol involved. As a matter of fact, the first night I would have won only $300. I can identify with what he did the second night, that's the way I would have done it without any alcohol involved. I guess I was first a gambler and then later on an accountant!!!!
  25. A couple of years ago, I had a client who earned $7,000 from his employer and no Income tax was withheld. The IRS sent her a letter stating that they were not going to issue her an ITI number because there was not a need for it. So I doubt the IRS will issue an ITIN just because they want to open or modify a bank account. That's not the function of ITI numbers. So file W-7 along with form 1040 and mail it. On a side note, if the US Embassy verifies her passport, you might be able to send just that document and not the original passport.
