It takes the IRS on average 2 years to get around to sending notices, but the always do on the MFS situation, since each of those returns has both SSNs on it.

Never fun to be the bearer of bad news. But be sure to let them know that, if they do not amend, the IRS WILL catch it, [usually takes them 2 years] and then there will be not only more interest but also penalties. If they amend now, odds are pretty good you can get the penalty portion abated, if they correct as soon as they learned of the error. That may help divert their natural anger from the 'bearer of the news' to the proper place, the original preparer.

Here's hoping they DO file suit. This sort of insanity is happening more and more these days, but this one went a huge step further I do think that spreading the word of what is happening is important too, because when I first started seeing such stories I thought "what idiots" but assumed it was an isolated incident. But it's spreading like wildfire now, and the current political climate is feeding the insanity, it seems. We need to all be looking at how our schools and our police are handling discipline and our rights as both parents and as honest citizens. If the true CRIMINALS have more 'civil rights' than honest citizens, IT IS UP TO US TO DO SOMETHING ABOUT IT.

Sad as it seems, she works and has some income, and she COULD leave him and file for divorce. The fact that she stays with him says that she has made a choice. And remember too that yoou are hearing only one side of the situation. He MAY be that bad, but since they have been together long enough to have adult children tells me there is something she is getting out of the situation. Stay out of it JB. If EITHER itemizes, the other has too as well, it's not a first filer wins situation.

I would not bother with it unless there is a VERY HIGH probability of them splitting up soon. I'd just note the details, and that the NC income was below the filing requirement, plus that if they had needed to file there would still have been no tax liability.

Kea, no part of the ROTH IRA should be taxable, as long as the five year rule is met. From the instructions to the preparer of the 1099-R: Use Code T for a distribution from a Roth IRA if you do not know if the 5-year holding period has been met but: The participant has reached age 59½, The participant died, or The participant is disabled. So my guess is that you need to check some box for 'has the 5 yr rule been met'. That will fix the problem.
