  1. on the put he sold before he purchased and then dates won't work so there must be a box or something I am missing. on the calls most have expired. but some again dates off. I know I am just missing where to lable

  3. thanks, sometimes we just over think. That's why I hate doing taxes in the last few days. I always say I am going to adopt a policy where only pickups in the last 4 days of the season April and October.... but never happens. I get suckered into doing them last minute
  4. I have a casualty loss on rental house (moble home). total loss. filled out 4684 pg 2. Loss is about 37,000 gain on rental otherwise is about 3,000 so I believe the loss is limited to 25,000 on the 8582. my loss should be 28,000. but I can't get it flow on the 8582. I don't know what I am doing wrong or do I just make the adjustment on the 4684. instruction say put a worksheet in showing how I came up with the deductble loss. any help would be appricated. I don't think I am going to make the deadline on returns

  7. How big of losses were they. She should have been able to take them if under 25,000 Go to asset form and go to sale tabs and fill in sale price and selling expense it should flow to the right forms
  8. ok so taxpayer owned house for 15+ years as personal residence then in July of 2008 moved to another state and rented out. Now in September 09 is selling the house. So does this mean that none of the house is eligible for the exculsion. or would it be that the half is eligible? 6 months in 08. ?? Any help please
  9. Isn't there a new law that starts in 2009 where you have to figure the gain different on personal residence sales and rentals. If you lived in your house 2 out of the last 5 years but rented out as rental part of the other years. I seem to remember there was a change. Can't seem to find it now to read up on it. Before all you had to do is pay on the deprecation taken after May of 1997. But now I think you have to pay on part of the gain as well. Anyone know?
  10. I called before two this afternoon and was on hold for a hour and 20 minutes. then called on my cell phone and got right thru. Lady told me the wrong amount off by 10.00 when invoice came thru. It wasn't worth my time to call back. Didn't say anything about a 20.00 fee. Suppose in was in fine print and I missed it. Recording said busy today because of re newals. Don't think they could of planed ahead. OH but wait it's ATX they don't plan or care.

  13. who files 8878? after looking at the form it seems I should have had all my extension using 4868 also sign a 8878 to efile it. I know this has been discussed on this form about not having anything signed because they don't have to sign a paper one but now I wonder...... have any of you had your client sign the 8878 before efiling the 4868?
  14. I have seen some post here and other forums where preparers are sending in a copy of the closing statement with the amended return. I see nowhere where they even ask for it. But after doing the 1040x and 5405 I can see where they may be fraud involved. it sure doesn't ask for much detail. I have always used the "don't send what not required" I always feel the people who open the returns don't know what the extra paperwork is anyway and it gets tossed. I think I'll just wait and see if they ask for more information Anyone else have thoughts on this

  17. she didn't want to have the parents amend and just left it and filed without claiming herself. We found out when trying to efile. She also lost the rebate of 600.00 But i want to know if we can claim the first time home buyers credit on the 2008 return even if she didn't claim herself. I have look and it only talks about aji limits
  18. how many vans is he renting out? If three or more he is a fleet and actual expenses are required. I think this will be like renting of equipment and go on Sch C. Since he is not driving I think actural expense is the way. How else would they be business miles.
  19. Does it matter that the home buyer is claimed on someone else return as dependent? Client was a student in 2008 and parent claimed her. Client got a very good job and earned about 35,000 in 2008. Was out of school in first of June 2008. I do not do the parents return. Now is ready to close on a house. Can I amend the 2008 and get the 8,000 credit or do I need to wait until 2009 return.

  22. Doesn't that still count for the 13,000 limit. If I bought my adult son a new car for 20,000 and paid directly to the auto dealer are you saying that would not count to the gift limit??
  23. Anyone receiving SS by a Feb. date qualifies for the 250.00. Add the money to the estate.
  24. Client just called and said the check that was paid with the extension bounced. they didn't transfer the money fast enough. (sure waited long enough to tell me) Should I just have them get their stuff ready and file the return with the payment or try to send the payment again. They still have a few items to gather and are slow about it. Won't the P & I still be the same based on when we pay the payment?
  25. But they would not qualify for the first time buyers credit. you can't buy from a related party.
