  6. I am much of that opinion. He has his records which are considerable and complete. My feeling is he will increase his percentage and leave it at that. I fully understand his concern as no one wants to sit down with two IRS auditors out of Richmond for a half a day or so.

  7. If this is the federal marketplace your client should be able to print that 1095A out himself by logging on to the site and downloading the 1095A. They are posted as messages in the mailbox there.

  8. Why all these sudden problems with the 1095A. Either they didn't get them; the got it and didn't know what it was for or (this one was really something) tried to do his own return by hand and figured the PTC without having the 1095A from the Marketplace. Also, wherever that Marketplace is, they need some attention. They told one client that they mailed it five times. How come the client didn't get at least one of those five? Am going nuts right along with the rest of you.

  9. My late clients are even worse for me because I'm I'm the process of moving and I can't dismantle my home office and get a final moving date until I'm done with this tax season. I'd like to be out of my current house by Oct. 30. The sooner I get this done, the sooner I can start packing for real. I'm almost done with the ones where I have all the info, but then there's a stack of 'missing one or two pieces' that I've requested over & over. And it's already stRted snowing in the Sierra. Don't want to move in the %}€^ cold through the snow!

  10. This was from 'Limited Liability Company & Partnership Answer Book,' third Edition, Alson R. Martin, Wolters Kluwer pub. I forgot I had it and, even then, had no clear idea of the search terms so began paging through. It was under Property of the LLC. Although it is in a 2012 supplement (why I forgot about it), I am counting on it to still be valid and am going with it. Makes life easier and the client will be much happier, too! Thanks again for the point in the right direction!

  11. Thanks again for the new direction, Ron. I went back to an old book I have on LLC and found just what you said. "Property is presumed to be owned by the LLC if purchased with the LLC's funds, even if acquired in the name of a member, manager, or other person." I have to amend the 2014 return for another reason (new data arrived this year - surprise!) so will remove that member loan. Everyone will be much happier now!

  12. My opinion is that you are over thinking it. It sounds like a case on intent over facts. It sounds like it was the intent that the LLC own the property. There have been cases just like this where the title did not dictate the circumstances. Barring any other idiocancries, I would be inclined to have the property in the LLC to begin with, with the title catching up to reality subsequently. Just my thoughts.

  17. Don't worry about the Oct 17 deadline; the estate is due a refund so the IRS doesn't care if the return is late. I believe that when the box is marked that an executor has been appointed, the refund check is made out to the estate. The return must be paper filed with the court appointment letter attached to the 1310. When no executor has been appointed, the return can be efiled and I think the check is made out to the administrator (wlho signs that they will distribute the funds according to the laws of the state). I've filed lots of both types, but alas no one alerts me as to how the check was delivered so I'm guessing. I wouldn't rush it. If the heirs want to argue about it they can just wait for their money.

  18. Sule Lamido and his sons were put on trail in 2015 for embezzling state funds by the Economic and Financial Crime Commission (I assume of Nigeria). I wonder what their business investment proposal is, do they need latex salespeople? They would have better luck contacting George Costanza.

  22. I agree. You should have claimed the short gap exemption for the 2015 year. Then, those months are taken into account in 2016 so that the short gap exemption can't be claimed again for the spring period because the consecutive months of lack of coverage at that point in 2016 does exceed 2 months.
