  1. However, it has been useful to have the facebook group to see or to report what's going on if there is a problem with the forum. I think that's why it was set up; so there would be an alternative just in case.

  2. The kittens mother is feral and had a litter of 5 kittens under our deck. We were able to catch the kittens and then lure the mother into the garage to feed them until we were able to wean them. Mother went off to a non profit that spayed her and then released her (she was too feral to adopt out). We kept these two and were able to adopt out the other three.

  3. Received two emails this morning that looked legitimate (not the usual grammar and spelling errors) asking if I was taking on new clients and offering to email me last years returns. Give away was the "Reply" email address did not match the "From" address and was really weird,( .jp instead of the usual .com or .org). I know most of you are very careful with these type of emails and just wanted to let everyone know that the bad guys are getting much better at making the emails look legit.

  4. There is one that I get regularly that comes from an email that is .corn instead of .com. Pretty sneaky. I think that extension allows them to use legitimate company names. The email address will be [email protected] or something similar. You gotta be vigilant on email. Tom Longview TX

  5. My assistants whine if I don’t cover them up with their blankets in the morning. Or if I don’t go upstairs to work on time! The traffic on the stairway can get a little intense, one likes to race by on the left, the other follows on the right. If I forget to leave space on the left, there can be a backup. Or a collision if I carry my water bottle too low on the right Saved from the meat market (really) in China. one has wonky front legs from being hung up for sale.

  6. Most of the phishing emails that I get go to my old, old email account that I never use for work or the one on my website that forwards them to another email not known to the public. They have become more sophisticated lately, but every one has a really strange email address. It really helps that I have only taken referrals for years. It's a scary world anymore.

  7. One downside to AI is it's helped the scammers to look more polished. The IRS has been sending out notices that the amount of phishing directed toward practitioners is at an all time high!

  11. I tell my clients to use a phone scanner app like CamScanner (or any of the others) and not to send pictures because they can't be read reliably. However, I have one lady who keeps sending me heic files. Adobe Acrobat reads them just fine (not sure about the Reader). Click the file, right-click and choose "open with" Adobe. One client would send me everything stapled to a fare-thee-well, until the year (after multiple warnings) I charged him a $50 staple removal fee, so named on the bill. I'm tempted to do likewise with photos of documents.

  13. My client that called the IRS was told that he needed to file a 1040X with no change to remove the flag from his account. Of course he wanted to file since the IRS told him to do that. So i printed him a return, put in the explanation that it was being filed in response to a CP2057 notice and gave it to him to mail in. I suggested that he attach a copy of the notice to the return. It made him feel better. I can't imagine that it will do anything but create more confusion with the IRS.

  15. Ugh. I just got a written earful, and threats of bad reviews and BBB reporting from a now former client. All because I pointed out a possible error, which now appears to be a knowing decision to defraud (the old "protest too much" theory). I don't worry about threats or bad reviews, and in this case, I suspect nothing will happen out of fear they will get caught. I reserve the right to be wrong, in case there is a statutory or other exception. Person asked why the W2 "I" prepared is different than the 1099 they received. "I own my own business (S-corp). I work under X and they do my billing, credentialing, etc. I am an independent contractor. I pay for their services and they give me a biweekly check minus their pay. Does that make sense? I bought your software to pay myself and give myself a W2 at the end of the year. " I shared information pointing to an employer/employee relationship. The result "Can I receive my money back for your services? I will be dealing with another company. Again, I did not ask for your opinion. Apparently I am dealing with a narcissist and as a counselor I would like to set a boundary. I will be reporting our conversations to BBB and anyone else who will listen including the referral source I was given for your software."

  16. My wife works for the med school / hospital of a major University and the tech group sends out phishing emails to all employees as a way to test if they are opening them and clicking the link. You can get a reward if you forward the email to tech to notify receiving it. All managers get notified if an employee gets caught. Compared to the phishing emails I get, they are sometimes VERY elaborate. Like NE, the email address is usually the easy sign, supposedly they've fixed that problem.

If they are not operating as an LLC they are a QJV under section 761(f)(2) If they are an LLC and if held as community property they can rely on rev. proc. 2002.69 and elect out of filing a 1065. It is basically a two prong test depending on whether they are an LLC or not: -if not an LLC go to sec. 761(f) -if an LLC go to 2002-69.

  19. Sounds like she did not have a named beneficiary so it went to her estate. And without a charitable contribution under section 642(c) the estate will likely have taxable income. A legal question. I could not sign the 1041 and take the charitable deduction without a legal document. And not deductible by the estate as either an income distribution or a charitable deduction. Unfortunately sounds like son was acting without any sound legal advice. Most likely it could have been resolved before son made the donation from the estate funds.

  22. Exactly, that's why I said to make sure there is time to correct it if the payment is rejected. I've had a couple instances where banks would kick back a joint refund where only one of the people was on the account.

  23. I'm guessing the way a lot of them are handled, there is not a lot of protection. How many times do people just go to the SOS site and form the LLC without having so much as Articles of Organization? Do they have documented meetings? Do they keep all transactions with members at an arms length transactions? If they need to use the protection, it's likely they are being sued. Plaintiff can subpoena documents to see if they are following the rules and requirements of an LLC, or if they are just using the LLC name. At the very least have them talk with an attorney regarding piercing the veil and then sign off that you have advised them a Sch E is not correct method.

  26. Like previously stated, unless in a community property state, there should be a dozen 1065's. I wouldn't put a lot of time in this return until you tell them the fee to prepare the 1065's. I'm guessing they may not want to pay and go to someone who would continue to handle it incorrectly even though it may circumvent the legal protection they tried to achieve by setting up all the different LLC's.

  27. The IRS will take $$$ out of a live account. They don't ask for a name, and don't care a dingleberry who is paying, as long as they are getting paid. I've seen parents pay for kids, kids for parents, one couple who paid tax due for a dear friend having a hard year... as long as the account is live, and there are sufficient funds in it, the IRS is happy.

  28. The elder generations still eat dog meat. The younger generations do not, but are not inclined to cause their elders to lose face by making a new law. We are part of a rescue group, and we are good at foster failing. (We foster failed twice with human pups too.)

  31. If no tax would have been due if the beneficiary had been changed to the church, looks like a legal matter. Further thought: As you point out, for a charitable deduction, the charity must be listed in the instrument; however, it also has to be noted that they are receiving the money from income, not corpus. It looks like it will end up as income to the estate... Interesting stuff

As long as your client doesn't get nervous, hang in there, but don't over promise to your client.

  36. The custodian has no way of knowing this is a 72t distribution, thus distribution code 1. There's no way they're going to change that and they are correct to take that position. It's the taxpayer's responsibility to fill out and attach the 5329 to indicate that it's a 72t distribution.

What is your FEIN and PTIN? Would you want the message you sent, with the ultimatum, shared? Say with the public, or your licensing entity? I mean really, what did you expect to get with such a threat? If you cannot make heads and tails out of printed reports a client sends you, or you are not making enough or able to charge enough to cover the software you need, why are you expecting something free (which you are going to use to make money) from us? Do you work for free?" I am omitting a screen image of their online ad (as an accountant/EA). == Received this back today "I am sorry I did not mean to be rude or threatening at all." == blah blah. I don't buy it. I don't have a great way to figure out which customer, nor am I going to ask the 5 possibilities - although I thought about it -I wish I knew, as I would ask them why they retain someone who tried to bully me.

  39. In my experience, not all brokers are knowledgeable. A few years ago I had a client whose broker advised her incorrectly about her RMD. She didn't really understand so I had to email the broker with a copy of the rules that applied to her situation.

  41. I wish that I still had some colleagues. All of my friends are retired, dead or got out of public practice quite awhile ago. I'm the last of everybody that I started out working with in the late 70s. My brother's CPA says that he can take some on, but I am still looking for others. Fortunately, I've had a few businesses go early and not taking on new clients for several years.

  42. FYI - Their wages in box 3,5 are an additional $15,500 or $19,000 as they are putting that in their SIMPLE.. Just trying to determine if box 1 for an IRA has to be the IRA amount of $7,500 plus the HI amount or if the IRA amount is enough and the HI is part of that.. Most of these are smaller S corps, either with other income or close to or are retired.
