  1. I believe that the only filing options for this person are MFJ or MFS.
  2. If youi are registered for E-Services and have a POA you can get the return transcripts, W-2 and 1099 info, etc. online. It's a lot faster than the form. There will not be any information about state withholding and the like, but that's true with 4506 as well.
  3. Thanks K.C. I was away from my office and couldn't for the life of me remember if this had been changed or not. It sure makes it easy to advise clients when the rules are constantly shifting up to the last moment. Don't even get me started on Cap & Trade! I live in the country and those rules will hurt us badly as our electricity is mainly generated with coal. Our Co-Op projects a 30+% increase in rates just because of that program alone.

  5. Please let me second Catherine's statement. See a doctor and get a check up. Tight chest and hurts to breathe could be very serious. At least you might be able to get some relief through treatment. (I recently had to use a body bag on someone who was "waiting it out".)

  8. Jainen, I think you misunderstood. My way = according to the Code. Client's way = "I need money. Get it any way you can." Carryback won't work in this situation as there has been no taxable income for years. The rebate would have been generated by SS payments received by deceased spouse. The only taxes paid in the last 6 years have been small SE tax liabilities.

  10. I have a client (for now anyway) who was late in filing their 2007 returns due to the death of a spouse and injuries received in an auto accident. The income on the 2007 return would have resulted in a $1200 Recovery Rebate Credit. The return was filed too late to get the credit, however. The 2008 figures result in a substantial NOL, so there is no rebate generated for 2008. This person insists that there is a form or "paper" that can be filed to get the missed credit from 2007. I know of no such procedure and have informed Client of this, but they are insistent to the point of harrassment. I just need some confirmation that I am correct on this, or that the form or procedure does exist so that I can file it and be done. I don't want to fire a client if I am wrong. Any comments appreciated.

  12. I teach Federal income Tax at the local Jr. college. I have had 3 or 4 H&R "tax school" graduates take the course. All have told me that they exceed the actual tax code knowledge that they got from the previous training in Chapter 2 of our text. These people are getting just basic training about filing status, exemptions, etc. and then the rest of the course is how to input data on the tax software. They follow a dialoge prompting system that guides them. They have no idea what the results are supposed to be. As I don't allow the use of software in my course, by the time they are finished, they know what is happening (hopefully!). That probably explains why so many are confused by form - based software.
  13. I believe that the problem is with the bank account. I seem to remember that it is not allowed to use the same account for direct deposits from 2 different returns in the same year. Try changing to another account or have a check issued and that should correct the problem.

  16. I have had similar things happen with both ATX and Drake. I wonder if sometimes the components do not load properly the first time.
  17. I had a client for years that was a single shareholder C-Corp and had himself on the payroll. When the work would stop for a while, he would file and draw unemployment with no problem. This was in Illinois also.

If the pond was built under an approved conservation plan from the Farm Service Agency (Soil & Water Conservation Service), it is eligible to be written off as a conservation expense subject to the limits you mentioned. If not, then the cost is capitalized into the land basis. Pub 225 is a good source of information. You could also talk to the local FSA office for more guidance. I have seen ponds built primarily as water resevoirs depreciated as a land improvement, but I would question that practice.
  19. It all depends on how the cancer policy is set up. If the pay-out is for medical expenses, then it's not includable in income. If the client is receiving $** per day in the hospital or off of work or the like, then it may be includable. The same applies to the deduction on Sch A . If the policy pays medical expenses, then it's deductable. If not, then you can't use it.

  22. Thanks KC. I tried the knowledge base with no luck. I guess I'll have to call support.What gets me is that this is happening on 2 separate computers in different locations with different operating sytems. (and different ISPs) I guess that I'm cursed.
  23. Perhaps it's the type of standard that is applied to those who vote on your agency's budget.
  24. In the last few days, when I update the program the dialog box freezes on the "connecting to server" message and doesn't change. If I click on the cancel tab after a while the "update completed" box appears. I tried downloading an update directly from the ATX website, but this is still happening. Any ideas?
