    Filing POA

    In April, I filed POA's on amended returns for three years. The POA's have been rejected four times because "the undersigned preparer did not prepare the returns in question." Finally, after letters and phone calls, I was contacted telling me to stop asking for POA's because "you did not prepare the returns." I curtly explained the POA's for for 1040X's. The comment was "OH." Then, "there is an X there." Problem solved, sort of, still not processed.

In case anyone is interested: FOIA Awareness for PTIN Holders The Freedom of Information Act (FOIA) requires the IRS to release certain information about PTIN holders including: Name Business name Business website address Business phone number Business mailing address – Either a physical address or a P.O. Box is acceptable as a business address. Email address – Any valid email address that you check regularly for PTIN communications is acceptable. Professional credentials PTIN application changes The IRS is changing the “Permanent Mailing Address” box on the PTIN application to “Personal Mailing Address”. This change clarifies that the information is personal and exempt from public disclosure under FOIA rules. Also, the IRS is removing the prohibition on entering a post office box in the “Business Mailing Address” box on the PTIN application. PTIN holders may now enter a P.O. Box as their business mailing address. If you used your Personal Mailing Address as your Business Mailing Address or used a street address when you would have preferred to provide a P.O Box as your Business Mailing Address, you may want to update your contact information. This information is not exempt from disclosure under FOIA rules and it will be released even if it is the same as your Personal Mailing Address. Updating your contact information To maintain the privacy of your personal information, PTIN holders can update contact information.   6. >>Where do I go for the test, or is it online?<< This is the IRS site that explains the test. The test itself, is giving at different sites which you can check online. As to reporting the CPE credits, the organization I belong to, reports them to both the IRS and CTEC (California requirements). Other CPE I have taken has been sent to CTEC by the provider. >>CPE, how does it work?<< You need to check and make sure you take the required courses. For California, it is one CPE equals 50 minutes of class at an onsite location. As to Internet or self study, the provider has the amount of hours approved CTEC, I would think, the IRS would works the same way.

  8. Obviously from Lion's quote from CCH, ProSystem users get more respect, not to mention more insight into what is going on. ATX: Server Errors when sending returns or retrieving acks 4/10/2012 Problem: Some customers are seeing a server error 12301 when receiving acks or sending returns. Other server error numbers could also manifest. Solution: Use KB article 1548 to delete all temporary internet files and cookies. Then retry connecting to the EFC to send returns or receive acks 30-45 minutes later. As customers contact the CS Dept, we are noticing that many are successful after following these steps. We are also noticing that the errors occur sporadically and do not affect all efilers. We don't even get a "Sincerely."
  9. I can't remember when, but I got this note from the FTB in early March after I had done a couple of C's. They just got their few bucks this week. "Self-Employment Tax Deduction The federal 2010 Tax Relief Act increased the amount of self-employment tax that may be deducted in computing federal adjusted gross income. California has not conformed to this change. For state income tax purposes, taxpayers may only deduct 50 percent (50%) of the self-employment tax paid in computing state adjusted gross income. The majority of self-employed taxpayers have not yet filed their 2011 tax return. We have updated forms and instructions and contacted all software companies to make this update. Make sure your tax preparation software allows for the Schedule CA line 27 adjustment if necessary. The following example shows how to compute this deduction: Self-Employment Taxes Paid, Form 1040 line 56(or 1040NR line 54) $2,000 Federal Deduction Allowed, Form 1040/1040NR, line 27 $1,150 Less: California Deduction Allowed, 50% of self-employment taxes paid $1,000 Schedule CA, line 27 (column adjustment $ 150 Important: Self-employed taxpayers who have already filed a return using the higher federal rate do not need to file an amended return. In order to reduce taxpayer burden, FTB is sending a letter to a limited number of taxpayers based on available information and considering the time and effort involved to revise this deduction. The letter will include an explanation of the issue, proposed corrected amounts, and allow taxpayer response before issuing a tax bill. Taxpayers who have already filed and are not contacted by FTB do not need to file an amended return."

    I am already seeing this. I have a very, very small practice, with the intent to retire, yeah right. I have had 10 "redo's" this year involving at least three back years from "legitimate preparers." I guess I qualify as a "repairer." Short example: Special needs adoption handled as "regular adoption. Did not carryover any expenses, even though wrong, was about 2K. After amending, the 2010 refund went from $350 to $23k plus.

The "wizzards" (in this case spelled correctly) also have decided when they think you do not need a form sent with the return it won't print it, unless you do a page print. Would not print Ca Schedule D because it is the same as the fed D. Wrong, the carryover was different as was one adjustment.
  12. It also flows when you choose "unknown country." It will not flow if the credit cannot be used, but goes to a carryback/carryover worksheet.
  13. It looks fairly simple. They walk you through the enrollment, then send they send you a PIN in a few days. Payments can be made online or by phone.
  14. I have never used it, but the Treasury's EFTPS should work. You can schedule payments up to a year in advance for individuals.
  15. I had problems with AVAST practically every time they "upgraded." A while back Eric recommended Microsoft's Security Essentials and I have used it ever since with no problems and less drain on my computer.

From ATX: ATX: Avast warning: The MX object was not found or registered 3/14/2012 Updated 3-14-12 5pm: The MX object was not found or registered When opening ATX and there is a new update, the setup starts to run but then you get the following 2 errors. “Setup Application: GLB21.tmp-bad image. The application or DLL c:\Windows\system32\OLE2.DLL is not a valid Windows image. Please check this against your installation diskette” AVAST Anti-Virus has updated its definitions and does not recognize ATX as a safe program, most notably the MX11.ocx which is required to allow ATX to run. AVAST is giving a false positive, meaning AVAST thinks the ATX file is a virus when the file is actually not a virus. Solution: click the link on AVAST that says “add the file to scan exclusion list” so AVAST can attempt to ignore the file and allow ATX to run. Also click the link that says “report the file as a false positive” or report it to the AVAST customer service department so they can change their program to allow this required ATX file. If adding the file to the exclusion list does not work, disable AVAST if that is an allowed option in your version. As a last resort, uninstall AVAST virus protection to run ATX. But be aware that you are without virus protection at that point and you need to install another anti-virus product immediately for your protection.

  19. You can also check from the Return Manager. Just high light on the return (do not open), then go to support then web sites.
  20. Your clients need to understand we can't do anything without their signatures. When they say "I'll get around to it," you need to make them understand the consequences of procrastination. Whether it be a later than expected refund or interest on a late filing, they need to understand that you are not their baby sitter. Believe me, I speak from experience with a few ex clients. They get a couple of calls or emails and then I have to move on.

    My ATX

    The few times a year that I go to "My ATX," I go through this sight. I use Google Chrome and haven't has a problem. When people started posting a problem, I went through the "community" and had no problem getting on. What it was worth, was as usual, not much.
