  1. The only thing I can think of is whether or not he really is itemizing, and how will she know when he isn't? At some point the mortgage may be paid off, and then will the real estate taxes, other taxes and other deductions continue to be enough for him to itemize?

  5. Oh yes, I had one last year that showed up beet red in the face and with a high fever. I didn't let him through the door. Shoved the returns in an envelope and told him to call if he didn't understand anything. Lysol on the door knobs and the chair he started to touch and in the air.
  6. I feel lucky! One of the few times I'm glad a client cancels is when they call and say they are turning back toward home because husband became ill on the way and actually had to stop at a gas station to throw up. The wife made a second great decision when she agreed to let me mail them the returns.
  7. Agree 100% but these people don't want anything mailed. They want to pick them up, and that's why I'm going to suggest paper filing right from the start, to avoid the possibility of one or both of them rejecting.
  8. I have 2 returns in right now with spouse's that passed during 2013. They both come from quite a distance and I'm contemplating recommending that they each paper file the returns. I'll leave the final decision up to them, but tell them that they could have this problem and might have to come back for a paper return.
  9. I don't think this is anything new with ATX because it would happen in my returns prepared with ATX at least once or twice a season. I always assumed it was something on the keyboard that I was pressing since the 1040 form opens with the cursor on the field for the taxpayer's first name, would happen on other forms too, or sometimes I'd start to type in numbers there.

After being with ATX since the beginning, I switched to Drake last February and have found it to be very reliable and fast, much faster than ATX and especially the functions of creating and transmitting efiles. Drake produces reports when efiles are created and another report when transmitted that appear instantly on the user's screen. Did you get those? Drake also immediately shows those transmitted returns awaiting acks with a "P" for pending right in the Personal Client Manager screen. Did you see those? Are you sure you didn't click on "Ack Only" since it is located right below the send button? We have a few Drake users here and none have mentioned this problem. I have never had this happen and don't remember seeing any posts about this issue on the Drake forum either. Are you a current Drake user and on their forum, or are you with ATX now?
  11. Found my answer in pub 969. For anyone else that's interested - Deducting an excess contribution in a later year. You may be able to deduct excess contributions for previous years that are still in your HSA. The excess contribution you can deduct for the current year is the lesser of the following two amounts. Your maximum HSA contribution limit for the year minus any amounts contributed to your HSA for the year. The total excess contributions in your HSA at the beginning of the year. Amounts contributed for the year include contributions by you, your employer, and any other person. They also include any qualified HSA funding distribution made to your HSA. Any excess contribution remaining at the end of a tax year is subject to the excise tax. See Form 5329.
  12. Would someone please check me on this scenario below. Young single guy contributes too much to his HSA in 2012 by $587, properly reported on 2012 form 5329 and pays the little penalty. His HSA contribution limit for 2013 is $3,250. He makes no contributions into it and he has no unreimbursed medical expenses. Form 5329, line 42 shows the excess contrib from LY of $587 First question - lines 43 and 45 show $3,250? (the excess of CY contrib limit over contribs paid in to the HSA). Is this the correct entry? Then on form 8889, line 2 is blank or -0- because no CY contribs, the limit of $3,250 fills in the appropriate lines (3,5,6,8,and 12). Here's my second question - instructions for the 5329, line 43 say: Also include on your 2013 Form 8889, line 13, the smaller of: Form 5329, line 43, or The excess, if any, of Form 5329, line 42, over Form 5329, line 44. The excess of line 42 over 44 would be the $587. Does this person actually get to deduct the $587 in 2013 that is the 2012 excess contribution because he didn't make any contributions into his HSA for 2013?
  13. Check the daugher's input again and make sure that box stayed checked. Last year in ATX, users would check that box and exit out of that form without moving to another field on that form, and that cause the checkmark in the box to not be there. Check the box and move to another field before exiting that screen.
  14. Check your ending balances from last year with his opening balances. He could have changed some things from 2012 after he gave you the file, or could have inadvertently used 2012 when doing his entries early in the 2013 year. I have one client that, even with a closing date set or the warning about a transaction being more than 90 days in the past, will still proceed and enter things with the wrong dates so that they end up in the wrong year.
  15. You would have a dissolution of the C corp. Here is a link to a very good article from the AICPA entitled "Now Is the Time - Converting a C Corporation to an S Corporation" that explains the issues: http://www.aicpa.org/publications/taxadviser/2012/august/pages/lynch_august2012.aspx The title makes it sound like it only covers C to S corps, but the pertinent discussion of C to LLC that would apply to your situation starts on page 6 of the file and in the document is labeled page 7 because the file created a blank page at the start that I deleted.
  16. Does your printer allow adding effects like a watermark? Mine does if I click on Properties and then Effects. It allows me to put any watermark I want, and I can choose the font, its size, color, shading. If you can't do it in your printer's settings, possibly you have a pdf editor that allows those effects where you could print a set to a pdf and then add in any watermark you want.

  20. Have you actually checked the math on the spreadsheet. Some people use excel like it is a word document, typing in the totals and not letting excel do the totals. Or maybe she missed some decimal points? I had one of those a couple of weeks ago where my client entered $101.94 for payment of his unemployment tax without the decimal point.

  24. I agree with jasdlm on this one. MAS, you didn't say how much the distribution was, but since it wasn't a direct trustee-to-trustee transfer, then what she really has is a taxable distribution and a contribution into an IRA caused by an improper rollover, and she could possibly even have an excess contribution that is subject to the 6% penalty.
  25. I'm going to have a forced break starting in about an hour. My BFF is coming over to have her return prepared while she goes over to town to pick up some supplements for her horse. This is the one return I do as a waiter. I only see my BFF about twice a year now and told her no time for a visit. That means she'll only stay about 2 hours. I think I'll go make some chocolate muffins and put on a fresh pot of coffee for us.
