  1. What I do is duplicate the return and make all the adjustments. Makes it fairly easy not having to input all the info twice.
  2. There should be a land component added to the basis. There would be a Sale of personal residence exemption but of course the depreciation is taken into account. Yes on NC return for any reportable amount and the fact that they may have received a 1099S at the closing that NC knows about. I had exactly same scenario, only I heard house soon after got wiped out in hurricane after all my work.

  4. The house is not considered a foreign financial asset, unless it is rented.

    Thanks Lynn, but I tried that again this morning and I still get DRAFT. Using ATX MAX program up to date, this is discouraging, same client, same problem last year. Still says 2/14 release date. No wonder Terry left.

    In Return Manager if you click on icon "Form Release" you will see the unfortunate news that Estimated Approval is 2/14. Happy Valentine's Day to us.
  12. Welcome to the Roaring Twenties. I mentioned that to a 20 something in my neighborhood while walking the dog and she looked at me puzzled. She then asked me what it was like living in the last century. I told her the 1900s were the best, best of music, cars, dancing and doing things without the help of a cell phone. Happy New Year everyone.
  13. Ha! I may be a little older than you since I've been preparing NY returns since '84 and I do agree it wasn't easy getting problem resolutions accomplished without a hitch. But I find it a lot easier now and I have good results online and when I call too. If I do need to call, being the kidder I tend to be I usually start off with something to lighten the mood and find the agents to be kinder and easy to deal with, but of course there are exceptions. Just like the kinder, gentler IRS, NYS is following their lead.
  14. That's right, I'm not far away from Catherine and they're around all the time. Yesterday there was a lone one standing in the middle of the crosswalk like a traffic cop. I kept inching up hoping he would go around me but he was more interested in my tire and kept pecking it. I took this picture from the porch the other day.

  16. Thanks Elrod, I'm just an old firehouse cook, my secret was making sure the meal was served late when everyone was so hungry they would eat anything. Last week we did a "Big Night" meal for friends (a must see movie with Tony Shaloub and Stanley Tucci) and we ate for hours. That's why I love this season, friends, family, and food and as the cook, you don't have to clean up.

If you were at my house for Thanksgiving dinner I would serve you first and offer you any part of the turkey you want, even though I'll be taking the chance that I may have to fight over the remaining leg and thigh.   20. Thank you everyone, you've given me enough information to advise the client to take the deduction. In their case the employer was not subsidizing any amount for COBRA. Whew! Glad Judy let me know going crazy for not finding anything was not my fault. Gail, the most official source I found was what Elrod referenced, Pub 535 among other non official sources like Nolo, I was all over the place. Here's the longer version from the Pub. Other coverage: You can’t take the deduction for any month you were eligible to participate in any employer (including your spouse's) subsidized health plan at any time during that month, even if you didn’t actually participate. In addition, if you were eligible for any month or part of a month to participate in any subsidized health plan maintained by the employer of either your dependent or your child who was under age 27 at the end of 2018, don’t use amounts paid for coverage for that month to figure the deduction.   21. I have a self employed client whose spouse was primary insured from his job. He was terminated and offered COBRA but clients declined and went out on their own. Would she, being SE be eligible to claim SEHI deduction even though insurance was offered through COBRA? I know if employer insurance was declined she would not be able to claim deduction but not sure if COBRA. I've been going crazy trying to research the answer and I come up with nothing, you're my last hope. Thanks, Bill

In my client's situation during the amnesty program we did the Streamlined filing and explained that the failure to file was non willful and by proving (with death certificate) that the taxpayer had passed away and he was the one in charge of family financial matters. Since he had years of cancer treatments he wasn't thinking straight. We filed the required 3 years of amended income tax returns and 6 years of FBARs but they did not charge any penalties. Also balances weren't large compared to some of the oligarchs out there. Balances were under 300K.
  25. A big part of this is showing Laura all these great posts and likes. She said I have a lot of wonderful friends who appreciate a good pair of shoes. I'm still working on understanding that. PS. She says she dresses from the shoes up.
